MM-KUU169 April 14, 2U'66 Item �B` RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public use and purposes, to -wit: for 81" Street widening project from University to Avenue Q and such other purposes as may be necessary under Texas Tax Code §311.008(b)(2); and WHEREAS, the City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes aforesaid: NOW THEREFORE: IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple interest to the tract of land further described a 0.294 acre tract of land being a portion of Block 37, Overton Addition to the City of Lubbock and a portion of Lot 1, L.I.S.D. Addition to the City of Lubbock, Lubbock County, Texas, further described in the attached "Exhibit A". SECTION 2. THAT the owner of said tract, the Lubbock Independent School District, BE offer through the Right -of -Way Department of the City of Lubbock the amount of $106,400.00, which is the amount appraised as the value and total damages for the fee simple interest, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated; and SECTION 3. THAT unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple interest. by the City Council this 14th day of April , 2005. Addition to the City of Lubbock, according, to the Map, plat, and/or dedication deed thereof recorded in Volume 2121, Page 49, Deed Records of Lubbock County, Texas, and a portion of 7,' Street previously closed by Ordinance No. 8781, recorded in Volume 2155, Page 348, Deed Records of Lubbock County, Texas, said 0.294 acre tract being further described as follows: BEGINNING at a 1/2" iron rod with cap set in the North right-of-way line of 8lb Street for the original Southwest corner of said Block 37 and the Southwest corner of this tract; THENCE N. 00005'06" W., along the East right-of-way line of Avenue U, a distance of 335.06 feet to a 1/2" iron rod with cap set for the most Westerly Northwest corner of this tract; THENCE N. 89053'27" E. a distance of 5.00 feet to a 1/2" iron rod with cap set for the most Easterly Northwest corner of this tract; THENCE S. 00005'06" E., 5.00 feet East of and parallel with the East right-of-way line of Avenue U, 'a distance of 295.06 feet to 1/2" iron rod with cap set for a point of intersection; THENCE S. 45005'51" E. a distance of 21.21 feet to 1/2" iron rod with cap set for a corner of this tract;.
