RESOLUTION
WHEREAS, the City Council of the City of Lubbock (the "City Council") adopted a
revised Comprehensive Plan (the "Plan") for the City of Lubbock on December 17, 2018
through Ordinance No. 2018-00141 in order to promote the public health, safety, and
welfare of the citizens of Lubbock, Texas and to promote sound, long-range planning and
development; and
WHEREAS, the Plan recommendations included the institution of impact fees to fund
certain future infrastructure needs within the city; and
WHEREAS, on May 14, 2019 through Resolution No. 2019-R0166, the City Council
approved a professional service agreement regarding the future infrastructure funding
study, which study will include future land use assumptions and a future capital
improvements plan, in preparation for the adoption and use of impact fees; and
WHEREAS, Section 395.058 of the Texas Local Government Code requires, on or
before the date of the public hearing on said future land use assumptions and capital
improvements plan, the City Council to appoint a Capital Improvements Advisory
Committee (the"CIAO"); and
WHEREAS, the City Council now desires to appoint to the CIAC its members, in
accordance with the requirements of Section 395.058 of the Texas Local Government
Code, which requires it be comprised of not less than five (5) members and include not
less than forty percent (40%) of the membership of the committee to be comprised of
representatives of the real estate, development, or building industries who are not
employees or officials of a political subdivision or governmental entity; NOW,
THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City Council of the City of Lubbock hereby appoints the CIAC members to
work with City staff and consultants throughout the impact fee study and implementation
processes; and
THAT the City Council of the City of Lubbock adopts the procedural rules for the CIAC
to follow in carrying out its duties, attached as Exhibit"A"and incorporated herein; and
THAT meetings of the CIAC shall be advisory in nature, a quorum of the CIAC shall be
four (4) members, and a majority vote of the quorum shall be required for any action to
be taken by the CIAC. All meetings and procedures of the CIAC shall be consistent with
the policies of the City of Lubbock concerning advisory boards and commissions. The
City Manager of the City of Lubbock, the City Attorney of the City of Lubbock, and
other City staff, or their designees, may attend all meetings of the Committee, and shall
serve as a resource to the CIAC as requested; and
THAT terms for the members of the CIAC shall be set in accordance with the City of
Lubbock's Policy on Boards and Commissions; and
THAT all CIAC members shall serve at the pleasure of, and may be removed by, the
City Council; and
THAT the City Council of the City of Lubbock appoints the following to be members of
the CIRC:

Capital Improvements Advisory Committee (CIAO)
Procedural Rules
Charge:
The Capital Improvements Advisory Committee (CIAO) committee serves in an advisory capacity
under Texas Local Government Code Chapter 395 and is established to:
(1) Advise and assist the City of Lubbock in adopting land use assumptions;
(2) Review the capital improvements plan and file written comments for the benefit of the
City of Lubbock City Council;
(3) Monitor and evaluate implementation of the capital improvements plan;
(4) File semiannual reports with respect to the progress of the capital improvements plan
and report to the City of Lubbock any perceived inequities in implementing the plan or
imposing the impact fee;
(5) Advise the City of Lubbock of the need to update or revise the land use assumptions,
capital improvements plan, and impact fee;
(6) File written comments on proposed impact fees before the fifth business day before the
date of the required public hearing on the imposition of the fees;
(7)File written comments on the proposed amendments to the land use assumptions,capital
improvements plan, and impact fee before the fifth business day before the date of' the
public hearing on the amendments;
(8) Serve in all aspects in order to fulfill the stated advisory committee duties under Texas
Local Government Code Chapter 395;
(9) Serve as an advisory and liaison committee to the City Council in the statutorily
required study for the consideration and potential imposition of impact fees;
(a) Conduct a minimum of two (2) public workshops to present and discuss items
related to the study for the imposition of impact fees; and
(b) Provide to the Council a recommendation regarding the study use of impact
fees.
Support: The City Engineer or his/her designee shall make available to the CIAC any professional
reports with respect to developing and implementing the capital improvements plan, shall provide
staff support, and shall serve as the responsible party for the overall support of the CIAC and its
operations.
Procedure: The CIAC shall follow the adopted policy regarding City of Lubbock Boards and
Commissions. Where Texas Local Government Code Chapter 395 prescribes specific statutory
obligations to the advisory committee, such shall govern the duties, operations and actions of"the
CIRC.
Legal Conformance: All meetings, actions, and other responsibilities and duties carried out by the
CIAO shall be done in conformance with all applicable federal, state, and local laws.
