HomeMy WebLinkAboutResolution - 2009-R0551 - Right Of Way - Patsy J Day - 12/02/2009 (2)Resolution No. 2009-RO551 December 2, 2009 Item No. 6.5 RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public use and purposes, to -wit: for the Lake Alan Henry Pipeline Project, and the City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the tracts of land further described in Exhibits "A" and "B" attached hereto, be acquired for public purposes and municipal purposes as set forth in the preamble hereof. SECTION 2. THAT the owner of said tracts, being Patsy J. Day, individually, BE offered through the Right -of -Way Department of the City of Lubbock the amount of S26,153.65, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings �to acquire the fee simple title of said tracts. Survey, Garza County, Texas and said pipeline centerline being described as follows: Beginning at a 1/2" iron rod with cap, set on the East line of said Section 104 for the beginning of this description, from whence the Northeast corner of said Section 104 bears North 1008'45" East, a distance of 91.06 feet, said point of beginning having a project coordinate of Y = 7090953.91 and X = 1175026.08; Thence North 60051'46" West, along the centerline of said Sixty -Foot (60') wide permanent pipeline easement, a distance of 194.10 feet to a 1/2" iron rod with cap set on the North line of said Section 104, for the end of this centerline description, whence the Northeast corner of said Section 104 bears South 881,50'32" East, a distance of 171.39 feet. Containing 11,76 rods.
