Resolution No. 2009—RO206 May 28, 2009 Item No. 5.12 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock, Change Order No. 6 to that certain Contract by and between the City of Lubbock and Eagle Contracting, L.P., for the (ITB# 07-730-BM), and related documents. Said Change Order No. 6 is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Date: I May 12, 2009 BID/ITB #: 07-730-BM Contract #: I 8119 I Project Name: Southeast Water Reclamation Plant Improvement Change Order within the scope of the contract means a Change Order that DOES NOT ALTER THE NATURE OF THE THING TO BE CONSTRUCTED AND THAT IS AN INTEGRAL PART OF THE PROJECT OBJECTIVE. After performance of a construction contract begins, Change Orders may be approved if necessary to 1) make changes in plans or specifications; or 2) decrease or increase the quantity of work to be performed or materials, equipment, or supplies to be furnished. Description of change (alteration, deviation, addition, or deletion) caused by conditions encountered during construction not covered by the specifications and drawings of the project (attach additional pages if necessary): This change Order includes the rerouting of the electrical duct bank for the generator, rerouting of influent line for Primary Clarifier 1, rerouting the 6-inch non -potable water line at the Plant 3 UV, repair of the gate frame for slide gate SG-108, rerouting of the Plant 3 Filter influent and UV effluent lines, revision of the door hardware at the 1MLS and BNR electrical buildings, modifications to the flange bracing for the filter complex covers, installation of manholes on the UV drain valves, repair of a leaking 12-inch potable water line, and replacement of mud valve MV-103. The total cost of this change order is $170,741.60. The new contract substantial completion date will be October 8, 2011. Change Orders must either be negotiated in the best interest of the City of Lubbock or put out for public bid by the Purchasing Department. Where the Change Order is negotiated, the Change Order must be fully documented and itemized as to costs, including material quantities, material costs, taxes, insurance, employee benefits, other related costs, profit and overhead. The existing pipe is at a higher elevation and also it is coming out from under the Clarifier at a different angle than show in the drawings.- We will have to add two fittings_ to align the tie-in point and one fitting to make up the elevation difference and pipe to make up for the difference listed above. Our new tie in point will also be under the existing asphalt paving. The contract Drawings did not call for us to repair this asphalt as the drawings anticipated that the tie in point would be outside of the asphalt drive. We have attached a proposed piping solution to solve these differences. How do you want to proceed? This method assumes that we would have potholed about 45 feet of piping to be able to give you the existing information for this line prior to ordering the CBCP for this line. The cost would have been about $6,200.00 less than the price I have previously given you. This method would start after the Plant has emptied Clarifier #1, then Eagle would take a day to remove about 45 feet of existing piping, then take two days to lay and tie-in the new piping, Eagle would take another day to pour & cure the CLSM encasement around the new piping. The next day we could start refilling Clarifier #1. The method that we have given you previously would take a half a day to remove about 20 feet of existing piping to the tie-in point and then a day and a half to lay and tie-in the new DIP (we would not have to encase this DIP because it is stronger than the CBCP). The next day we could start refilling Clarifier #1. Black & Veatch method using CBCP would require that Clarifier 41 be out of service for 4 to 5 days as compared 2 to 3 days for the method we have priced using DIP. Eagle Contracting, L.P_ would have requested the total Lump Sum Amount of Thirty Nine Thousand Three Hundred and Thirty Six Dollars and Ninety Cents ($39,336.90) to perform this work using Black & Veatch method using CBCP. Box 1600 Keller, TX 76244 Dear Mr. Grant: B&V Project 140092.6100 B&V File G-1.6 March 13, 2009 Subject: Modifications to slide gate SD-108 As discussed at Progress Meeting 11 on March 4, 2009, the frame and stems for slide gate SD-108 are bent and need to be repaired. This gate is on the influent end of the center screening channel. The gate will need to be closed when the existing screen is replaced with the new perforated plate screen. A visual inspection was made on the "below water" portion of the gate on March 51", and the only damage appears to be to the stems and above operating floor level. We request that Eagle review the slide gate and discuss repair options with Rodney Hunt, the gate supplier. The drawing from the shop drawings for when the gate was installed in attached to this letter. Initial thoughts discussed were to remove the gate above the operating floor level and weld on a new frame and replace the bent stems. Drawing No. CY4 and CY13 CONTRACTOR REQUESTS: ® Information ❑ Interpretation ❑ Clarification There are multiple problems with the existing locations for the Tie -In Points for the 42" Filter Influent and the 42" Effluent Pumping Station Influent. First of all the existing 36" Pump Station Effluent is 6 foot further East than shown in the Drawings and there is a 22 Y degree bend south of the tie-in point that will not allow for the tie-in as shown in the drawings. This existing line is also about 3 feet higher than shown in the Drawings. This could present a flow problem from the new UV Basin. We believe that we might have to move this tie-in point to the North to work with the existing bend that is not shown in the Drawings. Secondly, the tie-in point for the 42" Filter Influent will necessitate new piping under the existing monorail beam column and retaining wall. I believe that this tie-in point needs to be moved to the South (about 6 feet) to keep from endangering the existing facilities. Please tell us how you want to solve these existing problems so we can get this information to the pipe fabricator so they can redo the piping drawings to work with the existing piping. I have attached field drawings for your review. Dear Laura: During the review process on Shop Drawing Submittal 13122-150 it was brought to Eagle Contracfmg's attention that the Flange Bracing for the main roof beams shown in this submittal was unacceptable to the Engineer. After several telephone conversations and several face-to-face meetings with all parties involved a solution to correct this issue was proposed and submitted for review. It was approved in the return of this shop drawing today. As we discussed in several of these meetings, Eagle Contracting does not agree that unbraced flanges was a requirement of Specification section 13122 as it is not mentioned anywhere in this section or in the design criteria for the Metal Buildings in this Section. Eagle therefore did not feel that unbraced flanges was a requirement of this project when we took quotes at bid time, wrote our subcontract to Craig Wallace Construction and submitted this metal building submittal. During our numerous meetings, it was brought to Eagle's attention by PSC that the one cross section detail in the drawings for these buildings does not show flange bracing and that fact alone should have made us aware that unbraced flanges were required. Although Flange braces were not shown on this section view neither were any of the other cross braces, clips and tie rods that metal buildings need.
