RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to
execute a Change Order #5 and any associated documents with Eagle Contracting, LP, of'
Keller, Texas, for changes to the contract Southeast Water Reclamation Plant
improvements per contract ITB 07-730-BM, including various changes, including repair
of a leaking 12-inch water line, excavation of the Plant #3 filter complex and UV
Disinfection Basin, demolition of existing utilities and pressure testing of the grit suction
line at the Headworks Building, which Change Order #5 and any associated documents
are attached hereto as Exhibit A and made a part hereof for all intents and purposes.

Improvement
Change Order within the scope of the contract means a Change Order that DOES NOT ALTER THE NATURE OF THE THING
TO BE CONSTRUCTED AND THAT IS AN INTEGRAL PART OF THE PROJECT OBJECTIVE. After performance of a
construction contract begins, Change Orders may be approved if necessary to 1) make changes in plans or specifications; or 2)
decrease or increase the quantity of work to be performed or materials, equipment, or supplies to be furnished. Description of
change (alteration, deviation, addition, or deletion) caused by conditions encountered during construction not covered by
the specifications and drawings or theproject (attach additional pages if necessary):
This change Order includes the repair of a leaking 12-inch potable water line, rerouting of the chlorine line in the excavation
area of the Plant 3 Filter Complex and UV Disinfection Basin and demolition of the existing utilities, and pressure testing of
the grit suction line at the Headworks building. The total cost of this change order is $23,353.02. The new contract
substantial completion date will be September 6, 2011.
Change Orders must either be negotiated in the best interest of the City of Lubbock or put out for public bid by the Purchasing
Department. Where the Change Order is negotiated, the Change Order must be fully documented and itemized as to costs,
including material quantities, material costs, taxes, insurance, employee benefits, other related costs, profit and overhead.
ITEMIZED COSTS MUST BE FULLY DOCUMENTED AND ATTACHED TO THIS FORM.

Excavate 12" PW found to leaking through
the ground west of the Wash Water Tank.
After excavation it was found the Ductile iron
Pipe to be corroded and split. The resident
engineer Rich Houghton instructed Eagle to
make the repair. The
repair consisted of excavation / install SS
repair clamp wrap exposed area with Poly
wrap,install gravel around pipe and back fill.

We have located two existing Pipe Lines and one Electrical Duct Bank that are directly inside of the new
Plant 3 Filter Structure and UV Basin that are not located as drawn in the contract drawings. These two
lines and this duct bank will have to be re -located before we can build these two structures. The existing
obstructions are a 2'A" Chlorine Line, 6" Sludge Line and an'electrical duct bank (please refer to the
attached photograph and drawing that locate these three obstructions. Where do you want these lines
and duct bank relocated?

In regards to the 2 '/2" chlorine line, this line should be rerouted to the north of the
excavation area as indicated in the attached drawing. Contractor may modify
layout so that the pipe is located outside of the excavation slopes for the filter
complex and UV disinfection facility. The tie-in point may be modified in the field
based on the location of the existing lines.
In regards to the 6" sludge line, this line may be removed from service and
demolished if Eagle can make two connections on existing sludge lines by the
administration building and in the solids handling building. Once the 6" line is out
of service, it may be demolished to the extent is in the active construction area
and the ends plugged with concrete. The details for the two connections are
provided on the attached figures and shall be made concurrently in an 8-hour
shutdown.
Connection 1 — Tie in an 8" sludge line to a 6" sludge line to the west of
the administration building. This tie-in is estimated to be located in the
parking area west of the building, possibly beneath the handicapped
parking space. We recommend that the pipe sizes, material, and
separation be determined prior to ordering any piping. This will require
that the area be prospected and then the excavation remain open while
material is ordered. Once the connection is made, the asphalt paving
shall be restored. Eagle shall proceed with caution in excavating in the
area due to numerous utilities, Including a gas line.
Connection 2 — Tie in an 8" ductile line to a 6" Schedule 80 PVC line.
In regards to the duct bank, it is believed that the duct bank is not active and can
be removed. Eagle shall notify the plant 24 hours prior to removal.
Additionally, there is a 24-inch line near the alignment of the 42-inch line in the
vicinity of the generator that will be abandoned in place.
The Contractor shall submit a cost proposal for review for the additional work.

Demolish the Chlorine and Sludge Lines and Electrical Duct Bank in Plant 3
Structures per RFI-067 and directions given at the April 1, 2009 Monthly
Meeting.
Dear Laura,
Eagle Contracting proposes to demolish the existing electrical duct bank out of
the limits of the Plant 3 Structures, demolish the existing 24" Buie out of the limits of the
Plant 3 work (price assumes that we can give owner 24 hours notice of demolition and
then be able to demolish this piping without any holdups) and the reroute 2 Y2" CL2 Line
north of Plant 3 structures and tie back into original points and then demolish the existing
Chlorine Line out of the limits of the Plant 3 work. Cross -connect 6" Sludge to 8"
Sludge in Handicap Spots in Parking West of Administration Building and then Cross -
connect the 8" and 6" piping inside of the Solids Building per RFI-067 will be performed
and completed by the City of Lubbock in the next couple of weeks per the request of the
City of Lubbock in the April 1, 2009 Monthly Meeting. Eagle will demolish the 6"
Sludge Line out of the limits of the Plant 3 work when the City of Lubbock completes the
cross connection of this sludge line at the Solids Building and in the west Parking Lot of
the Administration Building.
Eagle Contracting, L.P. request the total Lump Sum Amount of Seventeen
Thousand Six Hundred and Eighty One Dollars and Seventy Cents ($17,681, 70). We
also request a contract time extension of 7 calendar days.

As requested by the Owner and You, Eagle proposes to run a Hydrostatic Pressure
Test on the Grit Discharge Line from inside of the Grit Basin to the Grit Pump Basin to
see if this line still holds the specified pressure.
Eagle Contracting requests the Total Lump Sum Amount of Three Thousand Two
Hundred and Seventy Eight Dollars and Seventeen Cents ($3,278.17) to provide this
extra work and a two day (2) Contract Time Extension.
