RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
land for municipal public use and purposes, to -wit: for 50th Street widening project
from Slide Road to Loop 289 and the City Council of said City finds it in the public
interest and for public purposes and municipal purposes to proceed with the acquisition
of lands as needed for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LU13BOCK:
SECTION 1. THAT the fee simple title to the tract of land further described in
Exhibit "A" attached hereto, be acquired for public purposes and municipal purposes as
set forth in the preamble hereof.
SECTION 2. THAT the owner of said tract, being Davila Family, LTD, a
Texas limited partnership, BE offered through the Right -of -Way Department of the
City of Lubbock the amount of $2,500.00 which is the amount appraised as the value and
total damages for the fee simple title and acquisition of said real estate purposes herein
stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby
authorized and instructed to institute condemnation (eminent domain) proceedings to
acquire the fee simple title.

Addition to the City of Lubbock, Lubbock County, Texas, as recorded by
Dedication Deed in Volume 1939, Page 342, Deed Records, Lubbock County,
Texas and out of Lots 10 and 11, Axe -Henderson Addition to the City of
Lubbock, Lubbock county, Texas, as recorded by Dedication Deed in Volume
1973, Page 804, Deed Records, Lubbock County, Texas, all having been
conveyed to Davila Family Ltd., of which said 0.005 acres (205 Sq. Ft.) of
land is more particularly described as follows:
BEGINNING at an "X" in concrete, found in the existing South right-of-way
line of 501h Street for the Northwest corner of said Lot 11, Axe - Henderson
Addition and for the Northwest corner of this parcel;
(1) THENCE South 86003'43" East, along the existing South right-of-way
line of said 50th Street and the North line of said Lots 7, 8, 9, 10, and 11,
Axe - Henderson Addition, 89.59 feet to an "X" in concrete, set in the
proposed South line of said 50th Street for the most Easterly corner of this
parcel;
(2) THENCE North 88059'47" West, along the proposed South line of said
501h Street, 89.54 feet to an "X" in concrete, set in the West line of said Lot
11, Axe - Henderson Addition for the Southwest corner of this parcel;
(3) THENCE North 01050'00" East, along the West line of said Lot 11, Axe
- Henderson Addition, 4.59 feet to the P.O.B. of which contains an area of
0.005 acres (205 Sq. Ft);
