Said Purchase Order is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Michael Zimmerman Sales and Applications Specialist —�uReiivE Preface The conditions affecting the installation of a vertical turbine pump should be thoroughly understood to avoid misunderstandings or disappointments later. These notes are intended solely as an aid to satisfactory operation. First of all, vertical turbine pumps, as the name implies, are designed to operate in a strictly vertical position. They are capable of being used at various angles with certain design considerations, but one factor remains extremely important; axial alignment must be maintained for proper operation. Any departure from true axial alignment or forced alignment of surface equipment can cause undue stresses in the pump and can result in pump failure that is not warrantable. Secondly, no guarantee is made against the erosive action of sand or other solids suspended in the pumped fluid. Small amounts of abrasive material may flow through the pump with little effect on the pump life or performance; however, continued pumping of such a material will eventually result in pump failure due to erosion. The only question is the length of time until failure. Finally, we do not guarantee that any pump will withstand the corrosive properties of the pumped fluid. When potentially corrosive situations are anticipated, suggestions may be offered regarding alternate materials of construction, but the life of those materials is not predictable nor is it covered under this warranty. WARRANTIES ARE LIMITED TO THE FOLLOWING: In the event that American Turbine Pump Company, Inc.(A.T.) is not paid in full according to the terms of it's agreement with the purchaser, all warranties are void; otherwise, A.T. guarantees all equipment of our manufacture against defective workmanship or materials for a period of one (1) year after the date of shipment from our plant. Items supplied by, but not manufactured by, A.T. are covered by the warranties of the respective manufacturers of the items. Copies of those warranties can be supplied upon request. If the purchaser claims the equipment or parts are defective within the one year warranty period, he or she shall notify the manufacturer immediately so that inspection of the equipment in question by an authorized agent or issuance of shipping instructions for return of that equipment can be undertaken. In the event the equipment or part is determined to be defective, it shall be corrected by repair or replacement, F.O.B. factory, and stich remedy shall be exclusive. The liability of A.T. arising out of or supplying said equipment, or its use, whether under warranties or otherwise, shall be limited to the correcting of defects, and upon the expiration of the one year, all such liability shall terminate. All other claims are waived. Specifically, A.T. will not be liable for the removal or replacement of any equipment from its installation nor will A.T. be liable for disassembly or reassembly of equipment by persons other than factory personnel, whether the said actions are done to correct warrantable defects or not. THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON FACE HEREOF. AMERICAN TURBINE PUMP COMPANY, INC.
