Said Memorandum is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. City ttorney H W.jslccdocs/Reso-LVAS.res December 19.2008 Resolution No. 2009--R0037 MEMORANDUM of UNDERSTANDING BETWEEN Lubbock Victim Assistance Services, Inc. and Lubbock Police Department I. Purpose When a person is victimized due to a criminal incident, a system exists so that the victim and/or family are never alone throughout the criminal justice process. Lubbock Victim Assistance Services, Inc. exists to provide support during the investigation/prosecution process and financial assistance for medical treatment necessary due to the criminal incident. The officers of the Lubbock Police Department, who investigate crimes occurring within the city limits of the City of Lubbock, Texas, will assist the victims of these crimes and advise them of the various agencies that will offer assistance by issuance of a blue pamphlet titled "Crime Victim Assistance Information." The Lubbock Victim Assistance Services, Inc. agrees to: ■ Assist victims with financial matters relating to their involved criminal offenses for which they are victims. ■ Assist victims with application for financial assistance relating to the Texas Crime Victims Compensation program. ■ Act as liaison with victims and University Medical Center and Covenant Health System. ■ Act as a liaison between victims and appropriate district attorneys offices regarding their pending cases involving such victims. ■ Act as liaison between victims and the Texas Attorney General's office for access to the Victim Information Notification Everyday program to offer safety assurances before and after court proceedings. ■ Assist victims in understanding their rights concerning the Texas Department of Criminal Justice (TDCJ) to include assistance with letters to and meetings with the TDCJ parole board members/commissioners. ■ Assist with counseling, referrals to other agencies and other specialized assistance. The City of Lubbock Police Department (LPD) agrees to: ■ Follow law enforcement established protocols regarding crime scene investigations and evidence collection and offer victim notification according to the Texas Code of Criminal Procedure Chapter 56, Subchapter B and Lubbock Police Department Policy and Procedures manual Sections 8.01.007(A)(3&4) Family Violence reporting and victim notification. II. Consideration The consideration for this memorandum shall be the benefits which accrue to the community each party serves as a result of each such party's performance of the covenants herein contained. However, neither party shall be liable for damages to the other party in the event of a breach of any such covenant or performance that fails to meet expectations. There is no monetary consideration between the parties to this memorandum. Each organization exists to perform its function independently of the other. There is no obligation on behalf of Lubbock Victims Assistance Services, Inc. to perform other than the LVAS is expected to perform according to the limitations and restrictions prescribed by the grant received from the Criminal Justice Division of the Office of the Governor of the State of Texas. There is no obligation on behalf of the Lubbock Police Department to perform other than the LPD is expected to perform according to the laws of the State of Texas and consistent with the Department's duties as a law enforcement organization. III. Effective Date This memorandum is effective upon 01/22/2009, and shall remain in effect unless either party shall notify the other of its desire to terminate this memorandum or replace it with a different memorandum of understanding.
