RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
land for municipal public use and purposes, to -wit: for 50`h Street widening project
from Slide Road to Loop 289 and the City Council of said City finds it in the public
interest and for public purposes and municipal purposes to proceed with the acquisition of
lands as needed for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the tract of land further described in
Exhibit "A" attached hereto, be acquired for public purposes and municipal purposes as
set forth in the preamble hereof.
SECTION 2. THAT the owner of said tract, being George H. McMahan and
wife, Linda M. McMahan, BE offered through the Right -of -Way Department of the City
of Lubbock the amount of $22,000.00 which is the amount appraised as the value and
total damages for the fee simple title and acquisition of said real estate purposes herein
stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby
authorized and instructed to institute condemnation (eminent domain) proceedings to
acquire the fee simple title.

Being 0.039 acres (1702.993 Sq. Ft.) of land out of Tract "A", Wester Park an Addition to the
City of Lubbock, Lubbock County, Texas, as recorded in Volume 1447, Page 847 of the Deed
Records of Lubbock County, Texas, said tract having been conveyed to George H. McMahan
and recorded in Volume 1368, Page 648 of the Deed Records of Lubbock County, Texas,
which said 0.039 acres (1702.993 Sq. Ft.) of land is more particularly described as follows:
BEGINNING at an "X" on concrete, found in the existing North right-of-way line of 50th
Street for the most Southerly Southeast corner of said Tract "A", Wester Park and for the
most Southerly Southeast corner of this parcel;
(1) THENCE North 88013'44" West, along the South line of said Tract "A", Wester Park
and the existing North right-of-way line of said 501h Street, a distance of 104.94 feet (call
105.00 feet) to a 1/2" iron rod, found for the Southwest corner of this parcel and a right-of-
way corner of Loop 289 as recorded in Volume 7154, Page 46, Official Real Property Records
of Lubbock County, Texas;
(2) THENCE North 0105332" East, along the right-of-way line of said Loop 289 as
recorded in Volume 7154, Page 46, Official Real Property Records of Lubbock County, Texas,
a distance of 14.02 feet to a 1/2" iron rod, found in the proposed North right-of-way line of
said 50th Street, for the Northwest corner of this parcel;
(3) THENCE South 8702249" East, along the proposed North right-of-way line of said
50`h Street, a distance of 101.08 feet to a 1/2" iron rod with cap, set for a corner of this parcel;
(4) THENCE North 46000'00" East, along the proposed North right-of-way line of said 50th
Street, a distance of 26.32 feet to a 1/2" iron rod with cap, set in the existing West line of
Englewood Avenue and the East line of Tract "A", Wester Park Addition as recorded in Volume
1447, Page 847, Deed Records of Lubbock County, Texas, for the Northeast corner of this
parcel;
(5) THENCE Southwesterly along the arc of a curve to the right, the Easterly line of said
Tract "A", Wester Park Addition as recorded in Volume 1447, Page 847, Deed Records of
Lubbock County, Texas and being along the existing West right-of-way line of said Englewood
Avenue, an arc distance of 16.55 feet to a point in the existing North right-of-way line of said
501h Street for a corner of this parcel, said curve has a radius of 557.07 feet, and a chord
distance of 16.55 feet;

Street, an arc distance of 23.17 feet to the P.O.B of which contains an area of 0.039 acres
(1702.993 Sq. Ft.) said curve has a radius of 15.00 feet, and a chord distance of 20.94 feet;
