RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, Change Order No. 1 to
that certain Contract by and between the City of Lubbock and S.J. Louis Construction
of Texas Ltd., LLP, for Downtown Waterline Replacement Project, and related
documents. Said Change Order No. 1 is attached hereto and incorporated in this
resolution as if fully set forth herein and shall be included in the minutes of the City
Council.

"Change Order" means a written order to a Contractor executed by the Owner in accordance with the contract authorizing an
addition to, deletion from, or adjustment or revision of the requirements of the contract documents, or an adjustment to the
compensation payable to Contractor, or to the time for performance of the contract and completion of the Project, or a
combination thereof, which does not alter the nature of the thing to be constructed and is an integral part of the project objective.
Adjustments to "Estimated Quantities" to a line item in a Unit Price contract do not require a Change Order. All work that alters
the nature of the thing to be constructed or that is not an integral part of the project objective must be let out for public bid.
Description of change (alteration, deviation, addition, or deletion) caused by conditions encountered during construction
not covered by the specifications and drawings of the project (attach additional pages if necessary):
This will allow the water department to remove and replace 2,250 linear feet of curb and gutter that was
installed in the late 30's and is now bad condition. After removal of the existing street water engineering
inspecting the existing curb conditions suggested the additional work. The work will be done by linear ft cost
$25.00 for Curb and gutter, $30.00 for Gutter, $4.00 additional base under curb, and $15.00 removal of the
existing curb. 30 days will also be added to the end of the contract making the final completion date June 12,
2009
Where the Change Order is negotiated, the Change Order must be fully documented and itemized as to costs, including material
quantities, material costs, taxes, insurance, employee benefits, other related costs, profit and overhead. Where certain unit prices
are contained in the initial contract, no deviations are allowed in computing negotiated change order costs.
ITEMIZED COSTS MUST BE FULLY DOCUMENTED AND ATTACHED TO THIS FORM.

This proposal addresses the additional cost for the labor, equipment, fuel, and material for the addNioml curb and gutter as requested in
CPR f1. The following costs are based on the infdnna*m contained in the protect plans anti specifications as well as the additkmal
information provided by HDR. The quantities shown below reflect the Information in CPR 91 as provided. Actual quantities will be field
measured and paid at the agreed unit prices. Please be advised that a removal item Is added due to the additional quantity anticipated.
The contact price under Bid Item 42 does not state that removal is part of the item, therefore the bid price was established to replace curb
and gutter only at locations where the construction of the new water main would require the wdsiing curb and gutter to be replaced during
construction operations.
