HomeMy WebLinkAboutResolution - 2008-R0306 - Appointment Of Temporary City Attorney - Donald Vandiver - 08_20_2008Resolution No. 2008-RO306 August 20, 2008 Item No. 1.1 RESOLUTION WHEREAS, the resignation of City Attorney Anita Burgess requires the City Council of the City of Lubbock to appoint an attorney to serve as City Attorney; and WHEREAS, the City Council deems it to be in the best interest of the citizens of the City of Lubbock study the various methods of obtaining municipal legal services to ensure that the City of Lubbock is receiving such services in the most efficient and effective manner; and WHEREAS, the City Council desires to appoint an experienced municipal attorney to serve as City Attorney during such time as the study is being conducted; and WHEREAS, Donald G. Vandiver, an attorney with more than 35 years of municipal law experience has agreed to serve as City Attorney; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Donald G. Vandiver is hereby appointed to serve as the City Attorney of the City of Lubbock on an interim basis until such time as his successor shall be appointed and qualified. SECTION 2. THAT upon passage of this Resolution, the City Manager or her designee shall make such changes to the municipal budget and such other matters as may be necessary to implement this Resolution. TOM MARTIN, MAYOR ATTEST: Rebec Garza, City Secretary Appointment-CityAttomeyRes August 14, 2008 Resolution No. 2008-RO306 DON VANDIVER BRIEF BIOGRAPHICAL INFORMATION Don has been employed by the City Attorney's office since 1972. He served as municipal prosecutor 1972-75; assistant trial attorney, 1975-81; first assistant city attorney from 1981 to 2003; and part-time assistant city attorney 2003 to present. He was a member of the first entering class at the Texas Tech School of Law and graduated with a Juris Doctor degree in 1972. He also has a BA degree from the University of Texas, 1967; and a Master of Public Administration degree from Texas Tech University Graduate School, 1982. Don also worked as a staff writer for the Amarillo Globe -News, 1963-65; for the Austin American -Statesman, 1965-67; and for the Lubbock Avalanche -Journal, 1967-69 and 1971-72. A veteran, Don served in the U.S. Army from 1969 to 72. His service included a tour of duty in South Korea. He has an extensive municipal law back ground and taught local government law at Texas Tech University in 1982-83, and 1983-84. He was voted Assistant City Attorney of the Year for 1995 by the Texas City Attorney Association and served on State Legislature's Open Records Steering Committee in 1995. Admitted to Texas Bar in 1972, he is also admitted to the U.S. Northern District of Texas and the U.S. 51h Circuit Court of Appeals. Don has two sons, one serving in the U.S. Air Force and one residing in Lubbock. He has been active in a number of Lubbock's civic and social clubs and the Presbyterian Church. He was born in Amarillo June 26, 1945.
