HomeMy WebLinkAboutResolution - 2008-R0305 - New Provision Requirements - City Manager And Director Of Water Utilities - 08_19_2008Resolution No. 2008—RO305 August 19, 2008 Item No. 2.5 RESOLUTION WHEREAS, pursuant that certain Resolution No. 2008-RO268 (the "Prior Resolution"), adopted by the City Council of the City of Lubbock on August 12, 2008, the City Council of the City of Lubbock authorized and directed the City Manager or Deputy City Manager, or either of such parties' designee, to execute and deliver for and on behalf of the City of Lubbock certain Survey Permits, as attached thereto as Exhibit "A", and Exhibit "B", respectively (the "Permits"); WHEREAS, it has come to the attention of the City Council of the City of Lubbock that certain land owners affected by the City of Lubbock's proposed water transmission pipeline may require certain special conditions or provisions regarding the activities permitted by the Permits; WHEREAS, so that the Lake Alan Henry Water Transmission Line Project may :)ceed in a timely and expedient manner, the City Council of the City of Lubbock, in the st interest of the citizens and water rate payers of the City of Lubbock, hereby desires to legate further authority to the City Manager, Deputy City Manager and Director of ater Utilities. IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council of the City of Lubbock hereby authorizes and directs the 'ity Manager, Deputy City Manager or Director of Water Utilities (the "Authorized ignatory"), to agree to special or specific provisions for and on behalf of the City of ubbock, to those certain (i) Survey Permits (Range Land); and (ii) Survey Permits cultivated Land), as approved by the City Council of the City of Lubbock in Resolution fo. 2008-RO268 (the "Prior Resolution"), as such Authorized Signatory shall consider xch special or specific provision necessary or advisable, and so long as said special or )ecific provisions do not (i) cause an increase in the cost to the City of Lubbock, in any ircumstance, an amount in excess of $5,000.00; and/or (ii) provide indemnity by the City reater than that provided in the Prior Resolution. by the City Council this 19th day of August 2008. elllaw _ �7 TOM MA TIN, MAYOR TTEST: Garza, City Secretary APPROVED AS TO CONTENT: Tom Adams, Deputy City Manager/Water Utilities Director APPROVED AS TO FORM: —'10 �, 52�� Richard K.
