RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to
execute a change order and any associated documents with Allen Butler Construction,
Inc., of Lubbock, Texas, for a change order to the contract for entrance road repaving and
informational signage improvements at Lubbock Preston Smith International Airport per
ITB 08-713-DD, which Change Order Contract and any associated documents are
attached hereto as Exhibit A and made a part hereof for all intents and purposes.
Passed by the City Council this 19rh day of August , 2008.

"Change Order" means a written order to a Contractor executed by the Owner in accordance with the contract
authorizing an addition to, deletion from, or adjustment or revision of the requirements of the contract documents, or
an adjustment to the compensation payable to Contractor, or to the time for performance of the contract and
completion of the Project, or a combination thereof, which does not alter the nature of the thing to be constructed and
is an integral part of the project objective. Adjustments to "Estimated Quantities" to a line item in a Unit Price
contract do not require a Change Order. All work that alters the nature of the thing to be constructed or that is not an
integral part of the project obieective must be let out for public bid. Description of change (alteration, deviation,
addition, or deletion) caused by conditions encountered during construction not covered by the specifications
and drawings of the project (attach additional pages if necessary) :
Change Order #1 consists of a pavement section change from a recycled base/asphalt section to an 8-inch
jointed concrete section on prepared subgrade. Refer to the attached letter from Allen Butler Construction, Inc.
The change is necessary due to the unavailabity of the specified asphalt arising from the bankruptcy of the
contractor's supplier, which occurred after the project had been bid and awarded. This change will affect
41,586 sy of pavement, and computes to an additional $21.71 / sy, for a total of $902,981.56 above the original
bid price. Additionally, the contract time will be extended by 3 weeks.
Where the Change Order is negotiated, the Change Order must be fully documented and itemized as to costs,
including material quantities, material costs, taxes, insurance, employee benefits, other related costs, profit and
overhead, Where certain unit prices are contained in the initial contract, no deviations are allowed in computing
negotiated change order costs.

Re: Availability of asphalt products.
Mr. Loomis,
As I am sure you are aware of, on July 2 1 " the local supplier of asphalt material (SemMaterials)
informed all of their clients that they were going into bankruptcy and would no longer be able to supply
asphalt material, (PG70-28, PG64-28, AEP & CSS l I). We have been unable to locate anew supplier for
PG70-28 or PG64-28. As a result we are unable to manufacture the specified hot mix asphalt for the
Airport Entrance Road project. We are currently working on a portion of the project that will be ready to
pave in one or two days, if this matter is not resolved by then the project will be at a standstill. Based
upon our conversations with the suppliers we do not believe the PG70-28 and/or PG64-28 will be
available for the foreseeable future. In our opinion there are two options for proceeding.
Option 1 would be to replace the asphalt paving with concrete paving. Eight inch (8') concrete paving
with dowels and dowel baskets on the transverse joints and tie -bars on the longitudinal joints would be an
additional $902,981.56
Option 2 would be to use PG64-22 asphalt material for an additional cost of $242,673.70.
