RESOLUTION
WHEREAS, the owner of 240.19 acres of real property further described in
Exhibit A hereto located south of FM 1585 between Quaker Avenue and Indiana Avenue
has filed a petition requesting annexation of said property with the City of Lubbock on
the 25th day of July, 2008; and
WHEREAS, the City Council has heard arguments for and against the requested
annexation at a meeting conducted on the 12th day of August, 2008; and
WHEREAS, the City Council of the City of Lubbock deems it to be in the best
interest of the citizens of the City of Lubbock to grant said Petition for Annexation;
NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT, pursuant to Section 43.028 of the Local Government Code,
the City of Lubbock hereby grants the Petition for Annexation attached hereto as Exhibit
A, which is incorporated herein and made a part hereof for all intents and purposes.
SECTION 2. THAT the City Planning Department and the City Attorney shall
prepare an annexation Ordinance for consideration by the City Council to annex the
property described in Exhibit A into the City of Lubbock.
Passed by the City Council this 12th day of August 2008.

PETITION FOR VOLUNTARY ANNEXATION
To: The Mayor and Governing Body of the City Of Lubbock, Texas
The undersigned owners of the hereinafter described tract of land which is
vacant or without residents, or on which less than three (3) qualified voters
reside, hereby petition the City Council to extend the present City limits in the
manner prescribed by the Local Government Code, Section 43-028, so as to
include and annex as a part of the City Of Lubbock, Texas, the property
described by metes and bounds on the attached Exhibit "A", which is
incorporated herein for all purposes. We certify that this Petition is signed and
acknowledged by each and every person or corporation owning said land or
having an interest in any part thereof.

Dear Mr. Henson:
FP Investors I, LLC ("FP I") is the current owner of approximately 320 acres of land on
the south side of F.M. 1585 between Quaker and Indiana. I am the sole Manager of FP I.
Currently, approximately 80 acres of the property (660 feet of depth off of F.M. 1585) is
in the City of Lubbock. We would like to petition the City to annex the balance of the
property so that we can submit a zoning application and land plan for the entire property.
Based on several meetings and discussions with Wood Franklin, we believe that the City
will be able to provide us with water and sewer.
We would appreciate any assistance you could provide us with respect to the annexation.

Re: Annexation of property south of F.M. 1585 (response)
Dear Mr. Robertson,
In your letter dated February 29, 2008 you requested approval from the City of
Lubbock for a proposed development located southeast of F.M 1585 and Quaker Avenue
to connect to the existing gravity sanitary sewer collecting into the 98`t' street sanitary
sewer main. As you are aware, the 98`h street sanitary sewer main was designed to service
the area one (1) mile either side of the main. With recent annexations by the City of
Lubbock there are areas within the City limits currently serviced by the 98«' street main
which has already exceeded the designed limits of this sanitary sewer main.
The City of Lubbock is currently performing a Sanitary Sewer Collection System
Master Plan. This plan will look at the current capacity of the Cities existing sewer
infrastructure and create a plan for fixture infrastructure to service proposed annexations.
Currently the 981h street sanitary sewer main has the capacity to service your
proposed development. This is a result of the undeveloped land within the planned service
area of the sewer main. Allowing recently annexed areas along with your proposed
development only creates a :future capacity situation for the City of Lubbock infrastructure.
Because the 98"' street main has additional capacity and the proposed development can be
serviced with gravity lines, Water Utilities can support the connection to this main. This
connection will need to be engineered so that the flow can be redirected in the future. I
expect an additional sanitary sewer main will be proposed in the master plan in the area of
F.M. 1585 to provide service to future annexation areas. Your proposed development
would be in the service area of this future main and should be designed so that the flow can
be diverted once the main is constructed.

Re: Annexation of property south of F.M. 1585
Dear Wood:
As you are aware, we will soon be submitting formal requests to annex into the City- of Lubbock
various tracts of land we own south of the current City limits.
We understand that the southern part of Lubbock County will face significant long-term
challenges for water and sewer service. However, we believe that there may be limited areas not
yet annexed which can physically be served by existing water and sewer infrastructure should the
City approve annexation.
Our engineering firm, Hugo Reed, has performed a preliminary study of our property located at
the southeast corner of F.M. 1585 and Quaker Avenue (North Half of Section 4, Block AK).
Our near -term desire is to obtain approval from the City of Lubbock to tie portions of this
development to the existing sewer main in Quaker Avenue north of F.M. 1585. The attached
sketch illustrates two areas within that half -section. The western area (outlined in green)
represents acreage we believe can be served by the existing sewer. The eastern area could be
served via a lift station and force main, if approved.
As per our previous discussions, we understand water service can be available to this property
(upon annexation) with routine water main extensions along the perimeter of the tract.
By this letter, we are requesting approval from the City of Lubbock to allow us to tie this
property to the existing sewer in Quaker Avenue once the tract has been annexed and
development of the property has begun.
