HomeMy WebLinkAboutResolution - 2005-R0071 - Easement Acquisition - South Lubbock Drainage Improvement Project - Melba Alford - 02_24_2005Resolution No. 2005-R0071 February 24, 2005 Item 19 RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional easements for municipal public use and purposes, to -wit: for the South Lubbock Drainage Improvement Project and the City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of easements as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the drainage easement to the tract of land further described in Exhibit "A", attached hereto, be acquired for public purposes and municipal purposes as set forth in the preamble hereof. SECTION 2. THAT the owner of said tract, being Melba Jo Alford, a/k/a Milbry Jo Alford BE offered through the Right -of -Way Department of the City of Lubbock the amount of $9,479.00 which is the amount appraised as the value and total damages for the drainage easement and acquisition of said real estate purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the drainage easement. Marc McDo gal, MAYOR Resolution No. 2005-R0071 EXHIBIT "A" METES AND BOUNDS DESCRIPTION of a 120.00 foot wide drainage easement located in Section 25, Block E-2, Lubbock County, Texas, being further described as follows: BEGINNING at a 1/2" iron rod with cap (North - 7,247,524.01, East - 924,452.42) set in the South right-of-way line of 98`h Street for the Northeast corner of this tract which bears N. 88° 14'41" W. a distance of 1041.00 feet and S. 01'44'04" W. a distance of 55.00 feet from an "X" on concrete found at the Northeast corner of said Section 25, Block E-2, Lubbock County, Texas; THENCE S. 01044'04" W., at a distance of 375.33 feet pass a 1/2" iron rod with cap, continuing for a total distance of 423.99 feet to a 1/2" iron rod with cap set in the North line of a 186.164 acre tract described in Volume 5847, Page 77, Real Property Records of Lubbock County, Texas, for the Southeast corner of this tract; THENCE Northwesterly, along the said North line of said 186.164 acre tract, along a curve to the left, said curve having a radius of 446.63 feet, a central angle of 11 *31'02"1 tangent lengths of 45.04 feet, a chord distance of 89.63 feet to a 1/2" iron rod with cap found at a point of tangency; THENCE N. 88014'41" W., continuing along the said North line of said 186.164 acre tract, a distance of 30.83 feet to a 1/2" iron rod with cap set for the Southwest corner of this tract; THENCE N. 01 044'04" E. a distance of 415.00 feet to a 1/2" iron rod with cap set in the South right-of-way line of 98'' Street for the Northwest corner of this tract; THENCE S. 88014'41" E., along the said South right-of-way line of 98`h Street, a distance of 120.00 feet to the Point of Beginning.
