HomeMy WebLinkAboutResolution - 2008-R0251 - Deny Application By SPS To Change Rates - 07_10_2008Resolution No. 2008-RO251 July 10, 2008 Item No. 6.2 ORDER AND RESOLUTION AN ORDER AND RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK SITTING AS A REGULATORY AUTHORITY PURSUANT TO §33.001 OF THE TEXAS UTILITIES CODE, WITH REGARD TO A RATE CHANGE APPLICATION FILED BY SOUTHWESTERN PUBLIC SERVICE COMPANY DB/A/ XCEL ENERGY ("SPS") WITH THE CITY. WHEREAS, pursuant to Section 33.001 of the TEXAS UTILITIES CODE, the City of Lubbock has exclusive original jurisdiction over the rates, operations, and services of an electric utility operating within the corporate limits of the City of Lubbock; and WHEREAS, SPS has heretofore filed a Statement of Intent and Application of Southwestern Public Service Company for Authority to Change Rates (the "Application") on June 12, 2008; and WHEREAS, the City Council held a public hearing on July 10, 2008 concerning the Application pursuant to TEXAS UTILITIES CODE §36.105; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT, based on the information presented to the City Council of the City of Lubbock, including but not limited to, the information contained in the Application and the request by SPS in its Application to deny their Application, the City Council of the City of Lubbock, pursuant to the applicable provisions of the TEXAS UTILITIES CODE, hereby DENIES the Application of SPS.
