HomeMy WebLinkAboutResolution - 2008-R0004 - Dedicate Real Property To Cemetery, Masoleum - 01_10_2008Resolution No. 2008-R0004 January 10, 2008 Item No. 5.7 RESOLUTION WHEREAS, the City of Lubbock, a municipal corporation organized under the laws of the State of Texas, owns and operates a public cemetery located at 2011 East 3151 Street in Lubbock, Lubbock County, Texas; and WHEREAS, the City of Lubbock has constructed a mausoleum within the corporate boundaries of the City of Lubbock Cemetery that is suitable for the interment of human remains; and WHEREAS, the City of Lubbock wishes to file in the Official Public Records of Lubbock County, Texas a map and/or depiction of the mausoleum property, and to dedicate said property exclusively to cemetery purposes; and WHEREAS, the City of Lubbock wishes to reserve the right to change the shape and size of the mausoleum, to resurvey the mausoleum, and renumber the crypts or niches located therein. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: That the Mayor of the City of Lubbock BE and is hereby authorized and directed declare, execute, and cause to be filed on behalf of the City of Lubbock the following: 1. That the tract and mausoleum depicted on the survey and maps made by the City and attached hereto are to be real property dedicated to cemetery purposes only, and said mausoleum is hereby designated as Mausoleum No. 1; 2. That the documents attached hereto accurately set forth the location within the City of Lubbock Cemetery of Mausoleum No. 1, as well as the dimensions of the crypt spaces and niches contained therein, and that each crypt space and niche shall be known and described by number specifically assigned to each one on said documents; 3. That the property depicted in the attached documents shall be used exclusively for cemetery purposes, including without limitation, for all purposes necessary or attendant to establishing, managing, operating, maintaining, improving, or conducting a cemetery and mausoleum, interring human remains, or caring for, preserving, and embellishing cemetery property; 4. That the City Council of the City of Lubbock may, by resolution or order, resurvey or change the shape and size of the property depicted on the attached documents, so long as that change does not disturb any remains interred in the property; provided, however, that if said change is made, amended documents shall be filed in the Official Public Records of Lubbock County, Texas; 5. That the City Council of the City of Lubbock has approved of the form of this dedication; 6. Any document deemed necessary to effectuate the purposes of this resolution.
