HomeMy WebLinkAboutResolution - 2006-R0048 - Authorizing Extension On Deadline Concerning Documents And Records - Atmos Energ - 01_26_2006Resolution No. 2006-R0048 January 26, 2006 Item No. 6.13 RESOLUTION WHEREAS, pursuant to Sections 102.001(b) and 103.001 of the Texas Utilities Code the City Council of the City of Lubbock is the regulatory authority that has exclusive original jurisdiction over the rates, operations, and services of a gas utility operating within the municipality; and WHEREAS, the City of Lubbock has not surrendered its exclusive original jurisdiction to the railroad commission as provided for in Section 103.003 of the Texas Utilities Code; and WHEREAS, the West Texas Division of Atmos Energy is the exclusive provider of retail gas utility service within the corporate limits of the City of Lubbock; and WHEREAS, the City of Lubbock, on January 12, 2006 passed Resolution No. 2006-ROO24 requiring Atmos Energy, pursuant to and consistent with provisions within the Texas Utilities Code to provide to the City of Lubbock certain documents and records relating to the rates, operations and services of the West Texas Division of Atmos Energy within thirty (30) days of the passage of said resolution; and WHEREAS, Atmos Energy has requested in writing that the deadline for filing the documents and records outlined in Resolution No. 2006-ROO24 be extended from February 11, 2006 to February 28, 2006; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT, after considering the request to extend the deadline outlined in Resolution No. 2006-ROO24 from February 11, 2006 to Februa 28 2006 the City Council of the City of Lubbock finds sufficient and just cause t GRAN / DENY (circle one) and further authorizes the Mayor to take such further action as necessary consistent with this resolution.
