RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT: the Mayor of the City of Lubbock BE and hereby authorized and directed to
execute for and on behalf of the City of Lubbock a contract for State legislative consulting
services between the City of Lubbock and HANCE SCARBOROUGH WRIGHT
WOODWARD & WEISBART, and any other related documents. Said Contract is
attached hereto and incorporated in this Resolution as if fully set forth herein and shall be
included in the minutes of the Council.

RE: Representation Agreement between Hance Scarborough Wright and the City of
Lubbock.
Dear Ms. Dumbauld and Mr. Platt,
Please take this correspondence as our firm's proposal to represent the City of Lubbock
before the Texas Legislature. Pursuant to my discussion with Mayor McDougal, we
propose to provide Lubbock with consultation and lobby representation beginning
January 1, 2006 and terminating December 31, 2007. This time period encompasses
representation before the interim legislative committees in 2006 and post -session in
2007, the 80th Regular Session (January 2007 thru May 2007), and any special called
sessions.
Lubbock would agree to pay our firm as follows:
January thru December 2006 - $7,500 per month;
January thru June 2007 - $12,500 per month.
July thru December 2007 - $7,500 per month
In the event that a special session(s) is called by the Governor, we agree that the fee
agreement for the months during a called special session will be reviewed and
negotiated by both parties.
The monthly fees are inclusive for the time and effort spent by members of our firm that
will be responsible for advocating Lubbock's interests in the legislative process.
Primarily, this includes myself, Legislative Consultant Robert A. Floyd, and Attorneys
Jay B. Stewart and Michael L. Woodward. In the event other members of our firm are
needed for other types of legal or lobbying work not normally expected in representation
before the Texas Legislature, such as litigation or Comptroller's Office state taxation
representation, we would agree to discuss and negotiate any additional fees required to
provide this type of unexpected legal work.
You additionally agree to reimburse our firm for any out-of-pocket expenses customarily
incurred by the firm in regards to the firm's representation. Unlike most firms, our firm
does not charge for telephone toll charges (including facsimile charges), copy expenses
(unless the copy project is too large for our staff and therefore must be sent off site) and
secretary/assistant time. Travel and other third party expenses will be billed to you at
cost. We will advise you and obtain your authorization for any extraordinary expenses
prior to incurring same.
The City of Lubbock expressly acknowledges that our firm has made no representation
or guarantees as to the outcome or resolution of any matters regarding the purpose of
this agreement.
