RESOLUTION CALLING A PUBLIC HEARING FOR DISSOLUTION OF THE
EXISTING VINTAGE TOWNSHIP PUBLIC IMPROVEMENT DISTRICT
WHEREAS, a petition for dissolution of the Vintage Township Public
�mprovemcnt District, created under Chapter 372 of the Texas Local Government Code
(the Act) pursuant to Resolution No. 2005-RO590 adopted by the City Council on
ecember 15, 2005, as amended by Resolution No. 2006-RO100 adopted by the City
Council on February 24, 2006, was received from the record owners of taxable real
property representing more than fifty percent (50%) of the appraised value of the real
property liable for assessment (as determined by the most current appraisal roll provided
,by the Lubbock Central Appraisal District) in the existing Vintage Township Public
Improvement District (PID) which covers a portion of an area in the north one-half of
Section 23, Block E-2 in the City of Lubbock, Lubbock County, Texas, generally
bounded by 114th Street on the North, Quaker Avenue on the East, 122 Street on the
outh, and Slide Road on the West, AND the record owners of taxable real property that
constitute more than 50% of all of the area of all taxable real property that is liable for
assessment; and
WHEREAS, the petition, a copy of which is attached hereto as Exhibit "A," has
been examined, verified, and found to meet the requirements of Sections 372.005(b) and
372.011 of the Act and to be sufficient for consideration by the City of Lubbock; and
WHEREAS, the boundaries of the existing Vintage Township PID are described
'in the attachment to the petition and shown on the map attached hereto as Exhibit "B,"
said area for the Vintage Township PID being within the city limits of the City of
Lubbock; and
WHEREAS, the Petitioners desire dissolution of the existing Vintage Township
ID so that they may separately request that the City create a new public improvement
istrict with the same boundaries as the Vintage Township PID to provide for public
mprovement projects and costs not included in the petition requesting or the resolution
creating the existing Vintage Township PID; and
�i WHEREAS, the City of Lubbock accepts the petition and desires to schedule a
public hearing to consider the dissolution of the existing Vintage Township PID;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1: THAT a public hearing is hereby scheduled at 10:00 am, Friday,
January 12, 2007, in the City Council Chambers, 1625 13th Street, Lubbock, Texas, to
receive public comment on the dissolution of the existing Vintage Township Public
mprovement District having the boundaries described in the petition attached as
xhibit A and as shown on the map in Exhibit B, pursuant to Chapter 372 of the Texas
ocal Government Code; and

SECTION 2: THAT notice of said hearing shall be published in a newspaper of
general circulation in the city before the 15th day prior to the hearing as required by state
law; and
SECTION 3: THAT written notice shall be mailed to each property owner, as
reflected on the tax rolls, of property liable for assessment, before the 15th day prior to
the date set for the hearing.

Re: Vintage Township Dissolution and New Petition for Creation
On Tuesday, December 12, 2006, the City Of Lubbock received two petitions from Paul D. Stell,
sole member of Stellar Land GP, L.L.C, the general partner of Stellar Land Company, Ltd. and
Vintage Land Company, Ltd. The first petition requests that the existing Vintage Township
Public Improvement District created by Resolution No. 2005-RO590 on December 15, 2005 and
amended by Resolution No. 2006-RO100 on February 24, 2006 be dissolved. The second
petition requests that the City of Lubbock establish a new Public Improvement District (PID) for
the Vintage Township development as shown on the attached map.
Public Improvement District dissolution and establishment can only be initiated by a petition of
property owners that meets two tests outlined in the state statute. These petitions meet both tests
required in the manner outlined below.
The first test is that the petition is sufficient if signed by the owners of taxable real property
representing more than 50% of the appraised value of the taxable real property liable for
assessment by the current roll of the appraisal district (January 1, 2005). The attached
spreadsheet of current values provided by Lubbock Central Appraisal District (LCAD) indicates
that the petitioner owns property valued. at $4,945,368, more than 50% of the total value of
$6,558,954.
The second test is that the petition must be signed by the record owners of property that
constitute more than 50% of the number of record owners or the record owners of more than
50% of the taxable real property within the PID. The petitioner has chosen the area method.
The total land area contained within the PID boundary is 275.539 acres. Total taxable parcel
area indicated by LCAD figures is 266.619 acres, with the balance being dedicated to the public
in streets and alleys. The petitioner owns 260.445 acres, which is 97.68% of the taxable real
property.
The notarized signatures on the Vintage Township petition were validated by a visual review.

DISTRICT CREATED PURSUANT TO CITY RESOLUTION NO. 2005-RO590 ON

TO: THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF LUBBOCK:
The undersigned petitioners (the "Petitioners'), acting pursuant to the provisions of
Chapter 372, Texas Local Government Code (the "Act"), as amended, request that the City of
Lubbock dissolve the public improvement district (the "District") created by the City pursuant to
Resolution No. 2005-RO590 adopted on December 15, 2005, as amended on February 24, 2006
by Resolution No. 2006-R0100, encompassing the territory described in Exhibit A attached
hereto (the "Land") within the City of Lubbock, Texas (the "City"). In support of this petition
the Petitioners would present the following:
Section 1. Standing of Petitioners. In compliance with the requirements of Texas
Local Government Code, Section 372.005(b), as determined by the current roll of the Lubbock
Central Appraisal District, the Petitioners constitute: (i) the owners of taxable real property
representing more than 50 percent of the appraised value of real property liable for assessment
under the proposal described in the petition that requested creation of the District and (ii) the
record owners of taxable real property that constitutes more than 50 percent of the area of all
taxable real property that would be liable for assessment under such proposal.
Section 2. Boundaries. The boundaries of the District are described on Exhibit A.
Section 3. Reason for Dissolution. Petitioners intend to request that the City create a
new public improvement district under the Act encompassing the Land that provides for public
improvement projects not included in the petition requesting the creation of the District. No
indebtedness to pay for the public improvements contemplated for the District has been incurred
by the City.
This petition will be filed with the City Secretary in support of the dissolution of the
District by the City Council as herein provided.
