RESOLUTION Item No. 5.7
A RESOLUTION REPEALING RESOLUTION NO. 2005-RO131 WHICH
PROVIDED FOR IMPROVEMENTS TO PORTIONS OF A STREET IN THE
CITY OF LUBBOCK, TEXAS, AND ALONG THE BOUNDARIES OF SAID
CITY AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Lubbock, by Resolution No. 2005-
R0131 passed on March 24, 2005, in regular session of City Council, provided for
improvements to portions of a street in the City of Lubbock, Texas, and along the
boundaries of said city; and
WHEREAS, Resolution No. 2005-RO131 additionally provided that the costs of
making such improvements shall be partly paid for the by the City of Lubbock and partly
by the owners of property abutting upon the said highways, streets, and avenues or
portions thereof which were thereby ordered to be improved, and the cost to be paid by
the owners to be a personal liability and charge against the true owners of such property,
all in accordance with and as required by Subchapter D of Chapter 314 of the Texas
Transportation Code; and
WHEREAS, the portions of highways, streets, and avenues which were to be
improved and the abutting property proposed to be assessed for said improvements are
described as Unit and Sub -Unit 2388-001, 98th Street from FM 1730 (Slide Road) to
Frankford Avenue; and
WHEREAS, by direction of the City Council of the City of Lubbock, Resolution
No. 2005-RO1 3 1 was recorded in the Real Property Records of Lubbock County, Texas;
and
WHEREAS, the City Council of the City of Lubbock has found that due to
changed conditions it is necessary and advisable to revise the paving policy of the City of
Lubbock by repealing Resolution No. 2005-RO131; NOW THEREFORE;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Resolution 2005-RO131, passed on March 24, 2005, is
repealed and held to be of no further force and effect.
SECTION 2. THAT the City Secretary be and is hereby authorized and directed
prepare a certified copy of this Resolution and to record or cause the same be recorded
the Real Property Records of Lubbock, County, Texas.
SECTION 3. THAT this Resolution shall take effect and be in force from and
its passage.
