RESOLUTION
RESOLUTION BY THE CITY OF LUBBOCK, TEXAS APPROVING PURSUANT TO §
104.111 OF THE GAS UTILITY REGULATORY ACT AN AGREED REDUCTION TO THE
TARIFFS AND RATES OF ATMOS ENERGY CORPORATION, LUBBOCK DIVISION, AS
SUCH TARIFFS AND RATES ARE OUTLINED AND ATTACHED TO THIS
RESOLUTION, AND PRESERVING RIGHTS UNDER THE GAS UTILITY REGULATORY
ACT.
WHEREAS, the City of Lubbock (the "City"), under the Gas Utility Regulatory Act
("GURA") of Texas, has original jurisdiction over the operations, services and rates of a gas
utility operating within the municipal boundaries of the City; and
WHEREAS, Atmos Energy Corporation, Lubbock Division ("Atmos") has agreed to a
non -cost of service related system -wide rate decrease; and
WHEREAS, the City has the authority under GURA § 104.111 to administratively
approve an agreed decrease in rates for Atmos without the delay and expense of a formal hearing
and without regard to the cost of service standard prescribed by GURA § 104.051; and
WHEREAS, Atmos has developed new tariffs and rate schedules that implement the
agreed rate decrease; and
WHEREAS, the City has determined that it is in the best interest of the citizens of
Lubbock to administratively approve the new tariffs and rate schedules that implement the
agreed rate decrease without the delay and expense of a formal hearing and without regard to the
cost of service standard prescribed by GURA § 104.051; NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS THAT:
SECTION 1. The tariffs and rate schedules attached hereto and incorporated herein as
though set forth fully herein as Exhibit 1, incorporating the agreed rate decrease, are just and
reasonable and are hereby approved pursuant to GURA § 104.111. Atmos shall implement these
tariffs and rate schedules as of the date of the execution of this Resolution.
SECTION 2. The City Council determines that it is unnecessary to hold a formal
hearing to approve the tariffs and rate schedules outlined in Exhibit 1 such tariffs and rate
schedules without regard and without any comment concerning the cost of service standard
prescribed by GURA § 104.051.
SECTION 3. Nothing contained in this Resolution shall be construed as a waiver by
either the City or Atmos of any other right, obligation, and/or remedy not specifically addressed
by this Resolution and otherwise available to either the City or Atmos under the GURA. Both
the City and Atmos specifically reserve any and all rights and remedies available to it under
GURA not specifically mentioned in this Resolution including, without limitation, the right to
initiate and prosecute a full cost of service rate case
SECTION 4. Atmos and the City have no reimbursable rate case expenses solely
associated with the implementation of the agreed rate decrease that forms the subject matter of
this Resolution.

This schedule is applicable to the sales to any industrial or commercial customer whose predominant
use of natural gas is other than space heating, cooking, water heating and other similar type uses.
Service under this schedule is available to eligible customers following execution of a contract specifying
the maximum hourly load. This schedule is not available for service to premises with an alternative
supply of natural gas.

This schedule is applicable to gas service to state agencies (as provided in Texas Utilities Code, Section 104.202)
including, but not limited to, state college and universities, MHMR schools, agriculture, highway and public
safety departments, prisons, and other facilities owned or operated by the State of Texas for the purpose of
heating, cooking, refrigeration, water heating and other similar type uses.
