RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, an Amendment No. 5 to the
Agreement for Engineering Services between the City of Lubbock and Parkhill, Smith &
Cooper, Inc. for the design and construction of Milwaukee Avenue between 34`}' Street
and 98th Street. Said Amendment is attached hereto and incorporated in this Resolution
as if fully set forth herein and shall be included in the minutes of the Council.
Passed by the City Council this 24th day of February 2006.

AND
PARKHILL, SMITH & COOPER, INC.
THIS Amendment No. 5 to Agreement for Engineering Services ("Amendment No. 5"),
dated effective this * Iday of � �<z , 2006, is by and between Parkhill, Smith &
Cooper, Inc. ("Engineer"), of 4222 85 h Str e� t, Lubbock, Texas, a corporation duly chartered
under the laws of the State of Texas, and the City of Lubbock, Texas ("Owner"), a Texas home
rule municipal corporation.
WHEREAS, pursuant to Agreement for Engineering Services, dated on or about
April 22, 2004, Resolution No. 2004-RO210 (the "Original Agreement"), Engineer agreed to
provide engineering services to Owner related to the design and construction of
Milwaukee Avenue, between 34`h Street to 98`h Street, in the City of Lubbock, Texas ("Project");
and
WHEREAS, the Original Agreement was amended pursuant to that certain Amendment
No. 1 to Agreement for Engineering Services (the "Amendment No. I"), dated effective
June 29, 2004 (Resolution No. 2004-R0300), as ratified by that certain Ratification of
Amendment No. 1 to Agreement for Engineering Services (the "Ratification"), dated on or about
July 21, 2004 (Resolution No. 2004-R0368); and
WHEREAS, the Original Agreement was amended to that certain Amendment No. 2 to
Agreement for Engineering Services (the "Amendment No.2"), dated effective
September 16, 2004 (Resolution No. 2004-R0425); and
WHEREAS, the Original Agreement was amended to that certain Amendment No. 3 to
Agreement for Engineering Services (the "Amendment No.3"), dated effective
September 28, 2004 (Resolution No. 2004-R0468).
WHEREAS, the Original Agreement was amended to that certain Amendment No. 4 to
Agreement for Engineering Services (the "Amendment No. 4"), dated effective March 24, 2005
(Resolution No. 2005-RO122).
WHEREAS, Owner and Engineer now desire to amend the Original Agreement, as
amended by Amendment No. 1, Amendment No. 2, Amendment No. 3 and Amendment No. 4,
as follows:
1. "ATTACHMENT `A', SCOPE OF SERVICES", and "ATTACHMENT `13%
COMPENSATION" to the Original Agreement are Hereby amended by adding
ATTACHMENT "A" , ATTACHMENT "B" and ATTACHMENT "C" to this
Amendment No. 5.

TO
AGREEMENT FOR ENGINEERING SERVICES
Owner: City of Lubbock, Texas
Project: Milwaukee Avenue paving from 34`h Street to 98`h Street
SCOPE OF SERVICES
The scope of services for Amendment No. 5 is as follows. Work will not proceed until Owner
has authorized Engineer in writing to proceed.
ADDITIONAL STUDY AND REPORT PHASE SERVICES - Milwaukee Avenue and 98th
Street Intersection.
PROJECT KICKOFF
1. Assemble available information from Consultant's files.
2. Meet with City Departments to review existing information. Receive City provided
information. Review City expectations for the Project. Departments include Street Engineering,
Traffic, Parks, Storm Drainage, Right -of -Way and Utilities.
3. Meet with adjacent developers/landowners to review future plans for the property
adjacent to the Project. Meet with all developers with one general meeting. Meet with the three
(3) major developers independently in a subsequent meeting.
4. Prepare Meeting Minutes to document the above meetings with City Departments and
adjacent developers/landowners. Deliver 10 copies to City for review and comment.
5. Meet with City to review meeting minutes. Revise and submit 10 final copies for
distribution.
PRELIMINARY ALIGNMENTS - 981h STREET & MILWAUKEE AVE.
INTERSECTION
General: Evaluate alternative alignments for 98th Street and Milwaukee Avenue
intersection. Consider future alignments of Milwaukee Avenue south of 98th Street and future
alignment of 98th Street west of Milwaukee Avenue. The 981h Street and Milwaukee Avenue
intersection should be as close as practical to the section corner to lessen the impacts on the
intersecting roadways and adjacent land use. The key consideration is Playa 94. With all
proposed alignments, analyze impacts to existing and future utilities. For all proposed
alignments, assume no outfall (drainage) improvements from Playa 94. Use existing studies to
determine 500 year flood elevation.
1. Intersection Alternative 1: Proposed Milwaukee Avenue curves to the east south of 98th
Street to follow the east edge of Playa 94, minimizing cut and fill requirements. Develop
schematic to maintain Milwaukee Avenue and 98th Street above the 500 yr, flood plain elevation
(1 cut and fill plan). Prepare preliminary roadway schematic and opinions of probable cost.
2. Technical Memorandum No. 1 (TM#1): Prepare TM#1 addressing possible alignments
of Milwaukee from 92nd Street to 94th Street based on Intersection Alternative 1 analysis.
Deliver 10 draft copies to City for review and comment within eight weeks of notice to proceed.
Revise and submit 10 draft copies for distribution within one week of receipt of review
comments from Owner.
3. Intersection Alternative 2: Proposed Milwaukee Avenue and 98th Street are centered on
the section lines. Develop a schematic level cut and fill plan to maintain Milwaukee Avenue and
98th Street above the 500 yr. flood plain elevation (1 cut & fill plan). Cut and fill plan to be
based on 500 year land reclamation for private use. Prepare preliminary roadway schematic and
opinion of probable cost.
4. Intersection Alternative 3: Proposed 98th Street follows the north edge of Playa 94 west
of Milwaukee Avenue, minimizing cut and fill requirements. Develop schematic to maintain
Milwaukee Avenue and 98th Street above the 500 year flood plain elevation. Prepare
preliminary roadway schematic and opinions of probable cost.
5. Prepare Technical Memorandum No. 2 (TM#2) for the alternatives described above.
Provide City with 10 draft copies.
6. Meet with City to review TM#2. Revise and submit 10 final copies for City review and
decision.
ADJACENT DEVELOPER/LANDOWNER COORDINATION
1. Arrange for and conduct a meeting with adjacent developers/landowners to review the
preliminary alignments. Conduct one meeting with all developers. Conduct subsequent
individual meetings with the three major developers. Document meeting discussions and
decisions.
2. Prepare Meeting Minutes to document the above meetings with adjacent
developers/landowners. Deliver 10 copies to City for review and comment.
PROTECT MANAGEMENT AND COORDINATION
1. Project Progress Meetings: Two per month, four month Preliminary Phase duration =
total of 8 meetings. Combine two of these meetings with other meetings planned. Includes
preparing Agendas and Meeting Minutes.
2. Contract Management: Four month duration.
3. Quality ControVQuality Assurance.
DELIVERABLES
1. Ten copies of all meeting minutes.
2. Ten copies of draft and final Technical Memoranda.

COMPENSATION
ADDITIONAL STUDY AND REPORT PHASE SERVICES
A. GENERAL
1. The Engineer will be paid on an hourly rate basis shown in Table B-1 and subcontract
personnel services will be billed at cost. Engineer and subcontractor reimbursable
expenses will be billed at cost plus 15 percent surcharge. Reimbursable expenses are
shown in Table B-1.
2. The Engineer agrees to use its best efforts to perform services as defined herein
within the billing limits stated below.
3. It is understood and agreed the maximum billing of each of the items listed below are
based on the start of Services being authorized not later than April 1, 2006. If start of
Basic Services is not authorized by date given, it is understood and agreed that the
upper billing limit will be adjusted accordingly by a supplement to the Agreement.
4. Monthly payments shall be made to the Engineer by the Owner based on Engineer's
statement. The statement shall be itemized to indicate the amount of work performed
and the associated reimbursable expenses and subcontract costs.
5. The uncontested amount of each statement shall be due and payable upon receipt by
the Owner. Carrying charges of 1-1/2 percent per month from the billing date shall be
due for accounts that are not paid within 60 days after the billing date.
6. The Engineer shall keep records on the basis of generally accepted accounting
practices of costs and expenses and which records shall be available for inspection by
Owner during normal business hours.
7. The Engineer shall provide adequate resources to complete the services described
herein within four (4) months of the date of the Owner's notice -to -proceed to the
Engineer.

1. The maximum billed for Services including personnel services and reimbursable
expenses for the Engineer is shown as follows:

C. ADDITIONAL SERVICES
Additional services must be authorized in writing by Owner.
1. The maximum billed for Additional Services will be determined by mutual consent
before the Additional Services are authorized by the Owner.
2. The Engineer shall start the performance of the authorized Additional Services within
ten (10) days of the receipt of notice to proceed and will complete the Additional
Services within the time period determined by mutual consent before the Additional
Services are Authorized by the Owner.

B. REIMBURSABLE EXPENSES

1. Travel, subsistence and incidental costs.
2. Use of motor vehicles on a monthly basis for assigned vehicles and on a current
mileage basis or rental cost basis for vehicles used for short periods.
3. Long distance telephone costs and project "onsite" telephone costs.
4. Reproduction of reports, drawings and specifications.
5. Postage and shipping charges for project -related materials.
6. Computer time charges, including program use charges.
7. Rental charges for use of equipment.
8. Cost of acquiring any other materials or services specifically for and applicable to
only this Project.
