HomeMy WebLinkAboutResolution - 2006-R0330 - Resolution Denying Rate Change Application Filed - SPS, Xcel Energy - 06_26_2006Resolution No. 2006 RO330_ June 26, 2006 Item No. 6.13 ORDER AND RESOLUTION AN ORDER AND RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK SITTING AS A REGULATORY AUTHORITY PURSUANT TO SECTION 33.001 OF THE TEXAS UTILITIES CODE, WITH REGARD TO A RATE CHANGE APPLICATION FILED BY SOUTHWESTERN PUBLIC SERVICE COMPANY DB/A/ XCEL ENERGY ("SPS") WITH THE CITY. WHEREAS, pursuant to Section 33.001 of the TEXAS UTILITIES CODE, the City of Lubbock has exclusive original jurisdiction over the rates, operations, and services of an electric utility operating within the corporate limits of the City of Lubbock; and WHEREAS, SPS has heretofore filed a Statement of Intent and Application of Southwestern Public Service Company for Authority to Change Rates (the "Application") on May 31, 2006; and WHEREAS, SPS has in its Application requested a consolidation of rate classes, an increase in depreciation rates, a characterization of TUCO, Inc. base rate energy costs as base energy rates, an increase in line loss factors, movement of municipal franchise fees to a direct charge to customers, an update of its service rules and regulations, an inclusion in base rates all purchased power capacity costs, and moving the revenue credit for demand revenues from eligible fuel expense to base rates; and NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT, pursuant to the applicable provisions of the TEXAS UTILITIES CODE and pursuant to the request made by SPS in its Application, the City Council of the City of Lubbock hereby DENIES the Application of SPS.
