Casner Natural Resources Attorney da/ccdocs/CSG-EnviroEngSvc.res August 31, 1999 Resolution No. 6496 Sept. 9, 1999 Item No. 25 AMENDMENT TO AGREEMENT FOR ENVIRONMENTAL ENGINEERING SERVICES This Amendment to Agreement for Environmental Engineering Services (the "Amendment"), dated this 9' day of September, 1999, is entered into by the City of Lubbock, a Texas Home Rule Municipal Corporation (the "City"), and Compliance Services Group, Inc. (CSG'). RECITALS WHEREAS, by Resolution dated November 16, 1995, the City and CSG entered into that certain Agreement for Environmental Engineering Services (the "Contract") providing for, among other things, the investigation of certain sites, and the development of assessment reports regarding said investigation (the "Investigation Activities"); and WHEREAS, although the Contract contemplates the Investigation Activities, the scope and cost for such Investigation Activities was unknown, and subject to negotiation, at the time of the entering into of Contract; and WHEREAS, by Resolution dated October 9, 1997, the City and CSG amended the Contract (the "Amendment") to add certain Investigation Activities to the Contract; WHEREAS, the City and CSG now desire that the Contract be again amended in certain respects; and WHEREAS, the City and CSG have agreed upon the following terms and conditions to modify the Contract. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: THAT for and in consideration of the mutual covenants contained herein and other good and valuable consideration, the City and CSG hereby agree, each to the other, as follows: 1. As of the date hereof, Items No. 5 & 6, on page 11 of the Contract, are deleted in their entirety and replaced for all intents and purposes by (i) the materials provided by the Amendment; and (ii) the materials described on Exhibit "A" attached hereto. 2. As of the date hereof, any and all of the terms and provisions of the Contract, except as modified and amended hereby, remain in full force and effect. EXECUTED on the dates as indicated below, but effective for all purposes as of the date of the Resolution of the City Council of the City of Lubbock authorizing the executions of this Amendment. I. Basic Services. Attend coordination meetings with the City of Lubbock environmental staff and with the TNRCC. [Estimated Cost — $3,000] IL Well Sampling - Episode #1 (a) Pull existing pumps and pre -purge wells. [Estimated Cost - $19,000] (b) Perform water well sampling for seven (7) site irrigation or monitoring wells. Purge three (3) well volumes with measurements conducted for well depth (feet) and depth to water interface (feet). Complete laboratory analyses for pH, temperature, and EPA Appendix IX constituents including volatiles (EPA 8260A), semi-volatiles (EPA 827013), organochlorine pesticides / polychlorinated biphenyls (PCB) (SW 8081), organophosphorous pesticides (EPA 8141A), chlorinated herbicides (EPA 8151), and metals (EPA 6010, 7470). Provide a simple format report of the laboratory findings. [Estimated Cost - $42,0001 (c) Store purged groundwater in an on -site tanker storage and discharge into the COL POTW sewer system upon approval. [Estimated Cost - $6,000] III. Well Sampling - Episode #2 Conduct a second round of sampling, as requested. [Estimated Cost - $48,000] IV. Well Closure. Plug and abandon four (4) irrigation or monitoring wells in accordance with TNRCC procedures. [Estimated Cost - $47,500] V. Monitoring Well Upgrades. Upgrade three (3) irrigation or monitoring wells in accordance with TNRCC procedures for monitoring wells. [Estimated Cost - $34,500] FEES: Fees for these services are based on hourly rates in Compliance Services Group, Inc. — Schedule of Rates for Engineering and Scientific Services and made a part of the original contract (page 6).
