HomeMy WebLinkAboutResolution - 6459 - Interlocal Agreement- Lubbock Reese Redevelopment Authority - Street Maintenance - 08_12_1999Resolution No. 6459 Aug. 12. 1999 Item No. 77 RESOLUTION NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Agreement by and between the City of Lubbock and Lubbock Reese Redevelopment Authority for street maintenance services, attached hereto and any associated documents, which Agreement shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Vandiver, first ssistant City Attorney cr: ccdocsgnterlocalCoopAgreeReese. res.doc August 4, 1999 INTERLOCAL COOPERATION AGREEMENT THE STATE OF TEXAS § STREET MAINTENANCE SERVICES COUNTY OF LUBBOCK § Resolution No. 6459 Aug. 12, 1999 Item No. 77 THIS AGREEMENT is entered into on the 25th day of August 1999, by and between Lubbock Reese Redevelopment Authority, hereinafter called "Reese," and the City of Lubbock, Texas, hereinafter called "City," both parties being political subdivisions of the State of Texas, pursuant to the authority granted by and in compliance with the provisions of the Interlocal Cooperation Contracting Act, Chapter 791, Government Code, and in furtherance of the purposes of said parties as provided by law. WHEREAS, Reese and the City desire to cooperate in the provision of street and parking lot maintenance services for streets and parking lots located within the jurisdiction of Reese, which is a governmental function that each party to this agreement is authorized to perform individually; and WHEREAS, the City has heretofore bid and contracted for street and parking lot maintenance services for the City pursuant to Chapter 251 of Local Government Code; and WHEREAS, Reese desires to make use of such contract services for streets and parking lots within its jurisdiction and further desires to have the City issue a change order to said street and parking lot contract to accomplish the needed street and parking lot maintenance services at Reese; NOW THEREFORE: WITNESSETH: 1. PURPOSE. The purpose of this agreement is to cooperate in the provision of street and parking lot maintenance services between the City and Reese to insure that streets and parking lots are properly maintained and do not deteriorate. 2. APPLICABLE LAW. For purposes of this agreement, the laws pertaining to bidding applicable to Texas municipalities are to be applied. 3. DUTIES OF THE CITY. The City agrees to seek a change order to its existing 1999 street and parking lot maintenance contract with Keystone Construction, Inc., of Austin, Texas, in the amount of $45,000 to provide additional street and parking lot maintenance services to be performed at Reese. In the event that Keystone shall refuse to execute said change order, this interlocal agreement shall be null and void and of no force and effect. 4. DUTIES OF REESE. Reese shall pay the City for such services as are performed at Reese. Such payments shall be made from current revenues available to the paying party and shall be made in such a manner that City payment to the contractor pursuant to the change order is not delayed. 5. TERM. The term of this agreement shall be from the date of execution by both parties through December 31, 1999. 6. EARLY TERMINATION. Either party to this agreement may terminate it upon thirty (30) days written notice to the other party. However, any expenditures or obligations already incurred by the City pursuant to this agreement prior to the time of receipt of notification shall be paid in full by Reese. 7. INDEMNIFICATION. Reese agrees to hold the City harmless from any claim of any nature whatsoever arising out of the performance of this agreement on Reese property.
