HomeMy WebLinkAboutResolution - 6449 - Agreement - Defense Logistics Agency - LPSIA Use During National Emergencies - 08_12_1999Resolution No. 6449 Aug. 12, 1999 Item No. 39 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Agreement by and between the City of Lubbock and Defense Logistics Agency for use of the Lubbock International Airport during times of national emergencies. Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. BELVOIR, VIRGINIA 22060-6221 Resolution No.6449 Aug. 12, 1999 Item No. 39 WHEREAS, the Defense Logistics Agency (DLA) may periodically require the use of services and property at the facility known as the Lubbock International Airport, located at Lubbock, TX and WHEREAS, the Lubbock International Airport, hereinafter referred to as the AIRPORT, agrees to provide such services and accommodations, NOW THEREFORE, the parties agree as follows: 1. The AIRPORT agrees to make available to the DLA such space within their facility as set forth in Addendum A to this Agreement, providing that the DLA notifies the AIRPORT of such requirement 24 hours in advance. The DLA will require use of such facilities only during times of national emergencies and natural disasters, and"the periods of occupancy will not exceed the duration of such emergencies or disasters. 2. The AIRPORT agrees to provide for any utility improvements, or facility alterations, which are expressly requested by the DLA and are further described in Addendum B. All costs for such installation, as well as recurring costs during the term of this Agreement shall be the responsibility of the DLA. The DLA shall have the option of removing any of these improvements at any time during, or following the conclusion of, this Agreement. The DLA shall bear the cost of such removal. Any costs to DLA for space or services provided by the AIRPORT shall not exceed the fair market value of such space or services. 3. The DLA users agree to coordinate with the appropriate air field security authority to obtain access to any restricted areas, and will further provide that authority with a roster of personnel and with any required personnel identification. 4. The AIRPORT further agrees to permit the DLA to conduct periodic inspections of the facilities in order to certify their continued suitability. 5. This Agreement shall remain in effect for a period of five (5) years from the date of execution, and may be extended on a year to year basis by the mutual agreement of the parties. This building would be available only in the event it is not leased by the Airport to a tenant. 2. This document constitutes the full and complete understanding of the parties. Modifications to this Agreement will have no force or effect unless reduced to writing and signed by the parties.
