Said contract amendment is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. URB 9901 (05) STATE URBAN PUBLIC TRANSPORTATION AMENDMENT TO GRANT AGREEMENT AMENDMENT # 4 THE STATE OF TEXAS § THE COUNTY OF TRAVIS § Resolution No. 6435 Aug. 12, 1999 Item No. 25 THIS AMENDMENT TO GRANT AGREEMENT made by and between the State of Texas acting by and through the Texas Department of Transportation, hereinafter called the "State", and The City of Lubbock, herein after called the "Recipient". WITNESSETH WHEREAS, on September 1, .1998, a Grant Agreement was entered into by and between the above -mentioned parties, which Grant Agreement provided for the expenditure of funds pursuant to the provisions of the Transportation Code, Chapter 455, which authorizes the State to assist the Recipient in procuring aid for the purpose of establishing and maintaining public and mass transportation projects and to administer funds appropriated for public transportation under Transportation Code, Chapter 456; and, WHEREAS, the State has available additional operating funds for the Subrecipient for Fiscal Year 1999. NOW, THEREFORE, in consideration of the mutual covenants herein set forth, the parties hereto agree to amend the above -mentioned Grant Agreement as follows: I. Article 3A, page 2, sentence 1 is revised to read "The maximum amount payable under this agreement without modification is $946,952.00. Exhibit A attached hereto is the revised project budget and shall replace the budget included with the above -mentioned Grant. II. All of the other terms, conditions and provisions of the original Grant Agreement shall remain in full force and effect. IN TESTIMONY WHEREOF, the parties hereto have caused these presents to be executed. Wilson, General Manager DATE: August 3, 1999 SUBJECT: Agenda Comments —August 12, 1999 City Council Meeting CITY OF LUBBOCK AGENDA ITEM SUMMARY H. CONSENT AGENDA # Consider a resolution authorizing the Mayor to execute Amendment #4 to Contract No. 51905F-1004 with the Texas Department of Transportation (TxDOT) for operating assistance. BACKGROUND/DISCUSSION: TxDOT is allocating an additional amount of $54,100 of public transportation funds to the City of Lubbock for operating assistance to maintain its public transportation system (Citibus) bringing the total annual for Fiscal Year 1999 in state operating assistance to $946,952. Amendment #4 to the original contract is effective through August 31, 1999. Acceptance of Amendment #4 will result in no additional cost to the City of Lubbock. SUMMARY/RECOMMENDATION: Citibus Staff recommends the approval of Amendment #4 to Contract No. 541905-1004.
