RESOLUTION
AN ORDER AND RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LUBBOCK SITTING AS A REGULATORY AUTHORITY PURSUANT TO SECTION
33.001 OF THE TEXAS UTILITIES CODE, WITH REGARD TO A RATE CHANGE
APPLICATION FILED BY SOUTHWESTERN PUBLIC SERVICE COMPANY D/B/A
XCEL ENERGY ("SPS") WITH THE CITY.
WHEREAS, pursuant to Section 33.001 of the TEXAS UTILITIES CODE, the City of
Lubbock has exclusive original jurisdiction over the rates, operations, and services of an
electric utility operating within the corporate limits of the City of Lubbock; and
WHEREAS, SPS has heretofore filed a Application and Statement of Intent to
Terminate a Tariff on June 1, 2006; and
WHEREAS, such proposed change will result in very little impact for the
customers of SPS; and
WHEREAS, SPS has represented to the City Council of the City of Lubbock that
such proposed change is not a "major change" as defined by Section 36.101 of the TEXAS
UTILITIES CODE; and
WHEREAS, such proposed change is not a "major change" requiring a public
hearing under the provisions of Sections 36.101 and 36.105 of the TEXAS UTILITIES
CODE; and
WHEREAS, pursuant to the representations made by SPS in their Application and
Statement of Intent to Terminate a Tariff, good cause exists for implementing such rates;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LUBBOCK:
THAT, pursuant to the applicable provisions of the TEXAS UTILITIES CODE notice
and hearing in this proceeding are waived, and pursuant to the representations made by
SPS in their Application and Statement of Intent to Terminate a Tariff, SPS shall be
entitled to terminate the Residential Prompt Payment Discount Rider as of June 1, 2006.
ORDERED AND RESOLVED by the City Council this 25th day of May, 2006.

Southwestern Public Service Company d/b/a Xcel Energy ("SPS") files this
Application to terminate and change electric service tariffs for service within the City of
Lubbock, Texas, ("City') in compliance with Section 36.102 of the TEXAS UTILITIES
CODE, and would show as follows:
I.
SPS files this Statement of Intent to terminate a tariff applicable to electric
service within the City. The proposed changes will allow SPS to bill uniform tariffs and
have consistent credit practices over its entire Texas service territory.
2006.
II.
SPS desires to have the effective date of the change to be operational on June 1,
SPS's proposed changes do not constitute a major change as defined in Section
36.101 of the TEXAS UTILITIES CODE and no hearing is required under Section 36.105 of
the TEXAS UTILITIES CODE.

IV.
The proposed changes are detailed below, including the affect the proposed
change is expected to have on the revenues of the company, and each class and number
of customers effected by the proposed changes.
SPS proposes to terminate the Residential Prompt Payment Discount rider, which
will eliminate the 2 percent prompt payment discount for residential customers. This
change only affects the Residential Class of customers, which includes approximately
25,850 customers. The effect of this change would be an increase in SPS's revenue.
During calendar year, 2005, 18,970 residential customers in Lubbock received a total of
$266,395.95 in prompt payment discounts.
V.
WHEREFORE, PREMISES CONSIDERED, SPS requests that the
proposed change be approved and its attached tariff be terminated effective June 1, 2006.
