RESOLUTION
IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, an Application for the FY
2005 EPA Special Projects Grant for the Canyon System Reuse Project (the "Grant
Application"), to be submitted to the Environmental Protection Agency, and all related
documents. Said Grant Application is attached hereto and incorporated in this Resolution
as if fully set forth herein and shall be included in the minutes of the Council.

As the duly authorized representative of the applicant, I certify that the applicant:
Has the legal authority to apply for Federal assistance, 8. Will comply with the Intergovernmental Personnel Act
and the institutional, managerial and financial capability of 1970 (42 U.S.C. §§4728-4763) relating to prescribed
(including funds sufficient to pay the non -Federal share standards for merit systems for programs funded
of project costs) to ensure proper planning, under one of the 19 statutes or regulations specified in
management and completion of the project described in Appendix A of OPM's Standards for a Merit System of
this application. Personnel Administration (5 C.F.R. 900, Subpart F).
Will give the awarding agency, the Comptroller General
of the United States and, if appropriate, the State,
through any authorized representative, access to and
the right to examine all records, books, papers, or
documents related to the assistance; and will establish
a proper accounting system in accordance with
generally accepted accounting standards or agency
directives.
Will not dispose of, modify the use of, or change the
terms of the real property title, or other interest in the
site and facilities without permission and instructions
from the awarding agency. Will record the Federal
interest in the title of real property in accordance with
awarding agency directives and will include a covenant
in the title of real property aquired in whole or in part
with Federal assistance funds to assure non-
discrimination during the useful life of the project.
4. Will comply with the requirements of the assistance
awarding agency with regard to the drafting, review and
approval of construction plans and specifications.
5. Will provide and maintain competent and adequate
engineering supervision at the construction site to
ensure that the complete work conforms with the
approved plans and specifications and will furnish
progress reports and such other information as may be
required by the assistance awarding agency or State.
6. Will initiate and complete the work within the applicable
time frame after receipt of approval of the awarding
agency.
7. Will establish safeguards to prohibit employees from
using their positions for a purpose that constitutes or
presents the appearance of personal or organizational
conflict of interest, or personal gain.
9. Will comply with the Lead -Based Paint Poisoning
Prevention Act (42 U.S.C. §§4801 et seq.) which
prohibits the use of lead -based paint in construction or
rehabilitation of residence structures.
10. Will comply with all Federal statutes relating to non-
discrimination. These include but are not limited to: (a)
Title VI of the Civil Rights Act of 1964 (P.L. 88-352)
which prohibits discrimination on the basis of race,
color or national origin; (b) Title IX of the Education
Amendments of 1972, as amended (20 U.S.C. §§1681
1683, and 1685-1686), which prohibits discrimination
on the basis of sex; (c) Section 504 of the
Rehabilitation Act of 1973, as amended (29 U.S.C.
§794), which prohibits discrimination on the basis of
handicaps; (d) the Age Discrimination Act of 1975, as
amended (42 U.S.C. §§6101-6107), which prohibits
discrimination on the basis of age; (e) the Drug Abuse
Office and Treatment Act of 1972 (P.L. 92-255), as
amended, relating to nondiscrimination on the basis of
drug abuse; (f) the Comprehensive Alcohol Abuse and
Alcoholism Prevention, Treatment and Rehabilitation
Act of 1970 (P.L. 91-616), as amended, relating to
nondiscrimination on the basis of alcohol abuse or
alcoholism; (g) §§523 and 527 of the Public Health
Service Act of 1912 (42 U.S.C. §§290 dd-3 and 290 ee
3), as amended, relating to confidentiality of alcohol
and drug abuse patient records; (h) Title Vill of the
Civil Rights Act of 1968 (42 U.S.C. §§3601 et seq.), as
amended, relating to nondiscrimination in the sale,
rental or financing of housing; (i) any other
nondiscrimination provisions in the specific statute(s)
under which application for Federal assistance is being

11 • Will comply, or has already complied, with the
requirements of Titles II and III of the Uniform Relocation
Assistance and Real Property Acquisition Policies Act of
1970 (P.L. 91-646) which provide for fair and equitable

PROJECT WORK PLAN
For many years the City of Lubbock (City) used land application as an alternative to
dispose of wastewater effluent. Wastewater effluent was not considered a valuable
resource, but a product that required disposal. A logical alternative at the time was to
use the water for farming purposes. This practice began in the 1930s when the City
piped treated wastewater effluent to a local, privately -operated farm. In the late 1980s
the City began purchasing and taking over the farming operations in order to
improve land application practices, farming operations, and groundwater
management.
Currently, the City is permitted to land apply a portion of its treated wastewater
effluent from the Southeast Water Reclamation Plant (SEWRP) to about 8,500 acres of
City -owned land and approximately 1,100 acres of privately -owned land. The
SEWRP currently provides secondary, but not tertiary, treatment. The Lubbock Land
Application Site (LLAS), which is located east of the City, makes up about 5,100 of the
City -owned acres. The long-term application of wastewater effluent on this site has
resulted in a "mound" of groundwater under the LLAS (i.e., the water table of the
underlying Ogallala Aquifer is higher under the LLAS than in the surrounding area).
The City developed the Canyon Lake System over 20 years ago (a.k.a., the Jim
Bertram Lake System). The Lake System is a series of small recreational lakes in
Yellowhouse Canyon that follow the stream bed of the North Fork of the Double
Mountain Fork of the Brazos River (North Fork). The City began pumping "excess"
groundwater from the LLAS to the head of the Canyon Lake System in order to lower
the mound of groundwater. This step has been taken to reduce nitrate levels in the
groundwater and to reduce the susceptibility of further groundwater contamination
by its close proximity to the surface.
In the late 1980s the City also developed Lake Alan Henry on the South Fork of the
Double Mountain Fork of the Brazos River (South Fork). Lake Alan Henry was also
developed in the canyon areas of the South Fork about 65 miles southeast of the City.
This Lake was developed as part of a plan for future water supplies. The head of the
South Fork is located approximately 20 to 30 miles south of the Hancock Land
Application Site (HLAS), which is the second land application site owned and
operated by the City.
By the late 1990s the City initiated an effort to reduce the amount of treated
wastewater effluent that was going to the land application sites. Up to 40% of the
effluent began to be treated to a higher quality and discharged down stream of the
Canyon Lake System. Currently the City recognizes that highly treated wastewater
effluent is a valuable resource, and that land application disposal is not the best use of
this water. The water may be beneficial to the canyon lakes in both the North Fork
and the South Fork.

Attachment A presents a schematic of the existing effluent disposal and reuse
transmission system, the location of the SEWRP, and the North Fork. A few third
party users (such as golf courses and recreational parks) have direct service taps on
this groundwater transmission line to take water for irrigation purposes. The
"recycled" groundwater is used to establish a continuous flow of water in the Canyon
Lakes System. However, this groundwater pumped from beneath the LLAS has
elevated nitrate concentrations, not uncommon in treated wastewater effluent.
Nitrate levels are reduced and other nutrients are removed from the groundwater as
it flows through the Canyon Lake System, but the groundwater does not contribute to
overall water quality until the Canyon Lake System has naturally removed the
nutrients.
To improve ground and river water quality and to enable reuse opportunities, the
City is designing improvements to the SEWRP. The SEWRP will produce a high
quality wastewater effluent that could be reused via transmission to the North Fork
and the South Fork to improve the water quantity and quality in area lakes. The City
is currently under contract with a consulting firm to design process modifications and
improvements to the existing SEWRP that would allow the plant to meet high quality
treatment standards required for stream discharge and reuse. Construction of the
SEWRP modifications is expected to begin in early 2008 and be complete by late 2011.
In conjunction with the SEWRP improvements, the City must also evaluate the effect
of the SEWRP effluent on the area lakes, determine the volume and quality of water
that can safely be discharged, determine the optimal discharge points, and begin
designing and constructing the infrastructure necessary for discharging effluent from
the SEWRP to the area canyon lakes. These steps will take the City closer to the reuse
opportunity. These tasks will be performed as part of the Canyon Lakes Reuse Project
proposed herein.

The City of Lubbock is located in the Texas High Plains, which is a semiarid region
located in the Texas panhandle that experiences periodic drought. The Texas High
Plains was once completely reliant upon the Ogallala Aquifer. However, with the
Ogallala Aquifer storage depleting, the City of Lubbock and the surrounding region
are seeking to identify and develop alternative water sources as well as water
conservation measures to reduce groundwater usage from the Ogallala Aquifer.
The City has land applied its treated wastewater effluent to irrigation fields since the
1930s. Prolonged use of land application sites has resulted in an elevated water table
creating a "mound" of groundwater beneath both sites. To reduce the elevation of
the water table below the LLAS, the City began pumping this groundwater to the
northern end of the Canyon Lakes System along the North Fork to replenish the
system. The presence of nitrate concentrations from the "recycled" groundwater from
the LLAS impacts water quality in the Canyon Lakes System and surrounding areas.
Therefore, the City has committed to take new measures by producing a high quality
wastewater effluent that can be used for stream discharge, which will: (1) improve the
water quality of the Canyon Lakes System, (2) maintain influent flow into the Canyon
Lakes System, (3) minimize groundwater quality issues of the sensitive Ogallala
Aquifer from the land application sites, (4) reduce groundwater pumpage from the
Ogallala Aquifer in order to supply water to the Canyon Lake System, and (5) provide
additional long term water supply alternatives for the City.

The City is proposing to use the referenced grant and matching funds for engineering
services and construction of infrastructure from the SEWRP to the Canyon Lakes
System as part of the proposed Canyon Lakes Water Reuse Project. In particular, the
proposed Canyon Lakes Water Reuse Project will include the following phases:
■ Phase I - Preliminary Engineering and Conceptual Design
■ Phase II - Engineering Design and Bid Phase Services
■ Phase III - Construction and Construction Phase Services
A description of the scope of work to be included in each of phase is included in the
text below.
3.1 Phase I - Conceptual Design and Preliminary Engineering
The City will contract with an Engineer to perform the preliminary engineering and
conceptual design services outlined herein. The project will build upon work
completed previously by the City to develop engineering and stream modeling
related to the City's SEWRP design and water right permit projects. The work to be
completed will consider all quality and quantity modeling necessary for the City to
consider maximum discharge and reuse opportunities while protecting and
enhancing the natural environment.
A. Identification of Alternative SEWRP Discharge Locations
1. The Engineer shall evaluate alternative SEWRP effluent discharge
locations in the North Fork and South Fork in order to improve water
quality and quantity for lakes in the Canyon Lakes System. The Engineer
shall review and/or establish alternative flow and loading scenarios at
each discharge location to meet the City's objectives.
B. Review Quantity and Quality Model Work Completed Previously
1. The Engineer shall review and build upon the North Fork quantity and
quality modeling work that is being completed by the City of Lubbock
through HDR Engineering, Inc. This work is being completed as part of a
water right permit application for discharge, storage, and reuse of storm
and wastewater effluent.
2. The Engineer shall review and build upon the North Fork modeling work
that is being completed by the City of Lubbock through Black and Veatch

Corporation. This work is being completed as part of the design project
for SEWRP improvements to enable stream discharge.
3. The Engineer shall review all work completed previously on the South
Fork by the City for Lake Alan Henry or by other agencies for known and
available resources.
C. Hydraulic Modeling
1. The Engineer shall ensure that the hydraulic modeling is complete and
shall develop it if necessary from existing work as outlined herein.
2. The Engineer shall develop a hydraulic model of the North Fork defined
area using HEC-RAS. The Engineer shall utilize the existing HEC-RAS
model developed for the Lubbock Flood Insurance Study and extend the
model for representative reaches upstream to include Canyon Lake No.1
through 6 and downstream to include Buffalo Springs, Ransom Canyon
Lake, and roughly 46 miles of the North Fork to approximately Route 380
near Post, Texas.
3. The Engineer shall perform a dye time of travel study on the North Fork
segment from Canyon Lake No.1 to the Ransom Canyon Lake Dam. The
results of this study will be used to calibrate the hydraulic model.
4. After calibrating the model, the Engineer shall evaluate the model at the
existing baseline conditions. In addition, the Engineer shall evaluate the
calibrated model at the various river flow rates, taking into consideration
the alternative effluent discharge locations and flow scenarios established
in Item 3.1.A.1.
5. The Engineer shall develop a hydraulic model of representative reaches of
the South Fork from the head waters of the South Fork to the Lake Alan
Henry on the same basis described in Items 3.1.C.2 through 3.1.C.4 for the
North Fork.
D. Water Quality Modeling
1. The Engineer shall ensure that the hydraulic modeling is complete and
shall develop it as necessary from existing work as outlined herein.
2. For the North Fork, the Engineer shall obtain the existing TCEQ QUAL-TX
model and extend the model for representative reaches upstream to
include Canyon Lake No.1 through 6 and downstream to include Buffalo
Springs, Ransom Canyon Lake, and roughly 46 miles of the North Fork to
approximately Route 380 near Post, Texas, using existing data such as
Flood Insurance Study models, GIS data, record drawings, and previous

reports and studies. The study should model the impact of proposed.
Lakes #7, #8, and scalping operations on the North Fork.
3. For the South Fork, the Engineer shall follow similar procedures as for the
North Fork, but the model shall include representative reaches from the
head of the South Fork to Lake Alan Henry.
4. The Engineer shall model stream quality for environmental, regulatory,
and reuse purposes. The model shall be evaluated to show the effect of the
alternative discharge locations and flow and loading scenarios established.
5. The Engineer shall consider both wet weather and dry weather conditions
for the North Fork, including storm water discharges from the City's
infrastructure.
6. The Engineer shall also consider the impact of a North Fork Scalping
operation on Lake Alan Henry.
E. Alternative Analysis
1. Based on the water quality modeling results, the Engineer shall establish
the most environmentally feasible discharge locations and flow and
loading scenarios to be evaluated. For each alternative, the Engineer shall
develop and identify the following:
a. The recommended quality of treated effluent needed for each
alternative. The Engineer shall specify if different levels of treatment
are required at the alternative discharge locations.
b. Necessary infrastructure required for each alternative, including new
wastewater effluent transportation infrastructure, water storage
facilities, wastewater effluent outfalls, improvements to the existing
reuse transportation system from the land application sites, diversion
pump stations, etc.
C. Water quality improvement measures, such as measures required to
increase dissolved oxygen levels or nutrients, required for each
alternative.
d. Estimated construction cost estimate for implementing the full-scale
project, including costs for construction of new infrastructure, land
acquisitions, permitting fees, legal and administrative fees, etc., as
appropriate.
e. A detailed description and evaluation of the environmental impact of
each alternative, both the potential adverse effects of the alternative
as well as the benefits to public health and environment.

2. The Engineer shall perform a comparative analysis of each alternative to
determine the most economically feasible alternative with the least
potential adverse effect on the environment.
3. Based on the alternatives analysis, the Engineer shall make a
recommendation to the City of which alternative to forward to final
design.
F. Coordination with Regulatory Agencies
1. The Engineer shall coordinate with the Texas Commission on
Environmental Quality (TCEQ) on any and all regulatory issues regarding
amendments to the SEWRP Texas Pollution Discharge Elimination System
(TPDES) discharge permit and the proposed reclaimed water distribution
system.
2. The Engineer shall coordinate with all other relevant Federal and State
agencies on any and all regulatory issues regarding construction of the
Canyon Lakes Water Reuse infrastructure from the SEWRP to the Canyon
Lakes system as required by the National Environmental Policy Act
(NEPA) for Special Appropriations Projects. At a minimum, the Engineer
shall meet ensure compliance with the Archeological and Historic
Preservation Act, the Endangered Species Act, Fish and Wildlife
Coordination Act, National Historic Preservation Act, Protection of
Wetlands, and the Safe Drinking Water Act.
3. The Engineer shall maintain a record of all correspondence with the
regulatory agencies and provide a copy of all relevant correspondence to
the EPA with the EID.
G. Preparation of a Preliminary Engineering Report (PER)
1. The Engineer will prepare a draft PER that includes the results of all
analyses, recommendations, and estimated construction costs. The
Engineer will submit the draft PER to the City for review.
2. Upon receipt of comments from the City, the Engineer will finalize the PER
and submit to the City.
3. The PER shall contain all information required of the Environmental
Information Document (EID) in accordance with the NEPA requirements
for Special Appropriations Projects, including:
a. Purpose and need for project emphasizing existing public health and
environmental problems,

b. Proposed project description and estimated construction costs,
including identification of funding sources;
C. Description of the existing environment and facilities in the project
area;
d. Alternatives analysis including description of each alternative and
evaluation of environmental impacts;
e. Description of anticipated environmental impacts and measures
proposed to mitigate adverse impacts of the selected alternative; and
f. Description of cumulative effects of this project in conjunction with
surrounding activities.
H. Preparation of the Environmental Information Document:
The Engineer will prepare the EID in accordance with the NEPA
requirements for Special Appropriations Projects based on findings of the
Preliminary Engineering Report.
2. The Engineer will submit, on behalf of the City, the EID to the EPA for
review and approval.
3.2 Phase II - Engineering Design and Bid Phase Services
The Applicant understands that the EPA must approve the EID prior to proceeding
with Phase II of this project. Once EPA approves the EID, the City will give the
Engineer a notice to proceed with the final engineering design and bid phase services
for the recommended Canyon Lakes Water Reuse System infrastructure as detailed
herein.
A. Engineering Design Services:
1. The Engineer will prepare drawings and specifications in accordance with
applicable State and local regulations for the recommended solutions
identified in the Preliminary Engineering Report.
2. The Engineer will submit to the City for review and comment a set of 50%,
70%, and 100% design drawings and specifications.
3. The Engineer will prepare signed and sealed construction documents for
public bid of the project.
4. The Engineer will provide permit assistance to the City for all aspects of
the engineering design and construction including, as appropriate,
building permits, TPDES discharge permits for the SEWRP, TPDES

permits for construction activities, water reuse notifications, construction
permits for wetlands, etc.
B. Bid Phase Services:
1. The City will advertise Package I of the Canyon Lakes Water Reuse System
for public bid and will accept bid proposals for Construction Contractors.
2. The Engineer will review the bid proposals and recommend the most
qualified Construction Contractor to the City.
3. The City will negotiate an agreement with the successful Construction
Contractor.
3.3 Phase III - Construction and Construction Phase Services
Upon successful negotiations with the Construction Contract, the City will issue the
Construction Contractor a notice to proceed with construction and the Engineer a
notice to proceed with construction phase services for Package I of the Canyon Lakes
Water Reuse System as detailed herein.
A. The Construction Contractor will mobilize and begin construction Package I of
the Canyon Lakes Water Reuse System.
B. The Engineer will make periodic inspections of the Construction Contractor's
work to ensure compliance with the Construction Documents.
C. Upon Substantial Completion, the Engineer will schedule site inspections with
TCEQ, EPA, and other regulatory entities, as required, for acceptance of the
construction. The Engineer along with the regulatory inspectors will develop a
punch list for the Construction Contractor to complete construction.
D. Once items on the punch list have been completed to the satisfaction of all
involved, the City, along with the help of the Engineer, will prepare the
appropriate project close out documents and final grant reports in accordance
with the terms of the grant agreement.
E. Note: The Applicant acknowledges that the grant funds assigned for
construction -related costs may not be sufficient to allow construction of the
entire Canyon Lakes Water Reuse System recommended in the Preliminary
Engineering Report. Without the benefit of previous studies and engineering
recommendations, the cost of construction for the entire Canyon Lakes Water
Reuse System is hard to estimate. The Applicant will use the available grant
funds specified in the Section 5 - Budget to construct Package I of the Canyon
Lakes Water Reuse System. Subsequent projects will be funded through
additional federal grants and/or the City's general budget for capital

improvement expenditures to complete the remaining phases of the Canyon
Lakes Water Reuse System.

The proposed Canyon Lakes Water Reuse Project has several potential environmental
benefits. First, reuse of high quality effluent from the SEWRP to the Canyon Lakes
System will improve the water quality of the Canyon Lakes System and will maintain
a constant influent flow into the Canyon Lakes System. Secondly, the high quality
effluent will also help improve groundwater quality by reducing the nitrate levels in
the water pumped to the Canyon Lake system that seeps down into the aquifer.
Finally, the proposed project provides a long-term alternative supply of high quality
water that can be used for irrigation and similar purposes, thus reducing the volume
of groundwater pump age from the Ogallala Aquifer. The high quality effluent from
the SEWRP will help reduce nitrate levels at the Land Application Sites.
In Phase I of this project, the Engineer will prepare a PER to document the results of
the alternative analyses and include recommendations for final design. The PER will
describe, in detail, the environmental impacts of construction as well as the public
health and environmental benefits for each alternative considered. The
recommendations presented in the Preliminary Engineering Report will be the most
economically feasible alternative that provides the greatest long-term benefit to public
health and the environment. In addition, the City will prepare an Environmental
Information Document in accordance with the National Environmental Policy Act
(NEPA) requirements for Special Appropriation Projects and will coordinate will all
relevant regulatory agencies to minimize adverse effects of the proposed project.

The total proposed budget for the Lake Alan Henry Water Transmission and
Treatment System Preliminary Engineering Study is $1,399,637. This project will be
partially funded through an EPA Special Projects grant, which the City was awarded
under the Consolidation Appropriations Act, 2005. The EPA Special Projects grant
has a value of $769,800 and was awarded for the "Canyon Lake Water Reuse Project
in Lubbock, Texas, for construction -related costs associated with water system
infrastructure." The EPA Special Projects grant requires the grant recipient to provide
a 45% match of the total project cost. The City is committed to meeting this 45%
match requirement of $629,837. A breakdown of the funding sources for the
proposed project is provided below:

Canyon Lakes Water Reuse System recommended in the Preliminary Engineering
Report. Without the benefit of previous studies and engineering recommendations,
the cost of construction for the entire Canyon Lakes Water Reuse System is hard to
estimate at this time. The Applicant will use the available grant funds specified above
to construct Package I of the Canyon Lakes Water Reuse Project. Subsequent projects
will be funded through additional federal grants and/or the City's general budget for
capital improvement expenditures to complete the remaining phases of the Canyon
Lakes Water Reuse System. Construction of the Canyon Lakes Water Reuse System
will be divided and coordinated such that each phase of the Canyon Lakes Water
Reuse System will result in a functional section of the infrastructure
