Vandiver, First Assistant City Attorney DDresMOTconlres.doc February 9, 1999 Resolution No. 6319 ` May 27, 1999 Item No. 20 LANDSCAPE MAINTENANCE AGREEMENT The city of Lubbock agrees to accept the responsibility for maintenance of the landscaping on the section of highway at the following intersections: • South Loop 289 at Slide Road • South Loop 289 at Quaker Avenue • South Loop 289 at Indiana Avenue • South Loop 289 at University Avenue The City can allow another group or organization to be involved in the maintenance of the landscaped area. By signature below, the City acknowledges the hazardous nature of the work and agrees to the following terms and conditions: • Any work performed, trees or shrubs planted, or appurtenances built shall not endanger the traveling public or restrict sight distance. All traffic signs and signals must remain visible to the public. • The section of highway shall be kept in a neat and aesthetically pleasing manner. • The city shall furnish all labor, equipment and materials as may be required for the landscape development and maintenance of this section of highway after the original landscaping components are constructed by the Texas Department of Transportation. It is understood that the Texas Department of Transportation, by execution of this Agreement, does not impair or relinquish the Department's right to use such land for right-of-way purposes when it is required for the construction or reconstruction of the traffic facility for which it was acquired, nor shall use of the right- of-way under such Agreement ever be construed as abandonment by the Department of such land acquired fortWway purposes.
