HomeMy WebLinkAboutResolution - 091478Z - Real Estate Acquisition For Public Purposes - Phyllis Wheatley Addition - 09_14_1978blb RESOLUTION ��►1'� WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine the public needs, and welfare demands and creates a public necessity for the operation, im- provement, expansion, extension, construction, reconstruction, repair and main- tenance of electrical transmission and distribution lines, poles, braces, and guy wires and necessary apparatus and appliances in connection therewith necessary to the proper operation of the public electrical utility system owned and operated by the City of Lubbock, Texas, which requires the acquisition of title in said City to an easement for such public municipal purposes together with rights of ingress, egress, and regress in said City to accomplish such purposes; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT title in the City of Lubbock, Texas, to an easement in, upon, over, along, and across the hereinafter described real estate located in the City of Lubbock, Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: Two tracts of land out of Lots 1 and 2, and Lots 4 and 5, Block 12, Phyllis Wheatley Addition to the City of Lubbock, Lubbock County, Texas, being more particularly described as follows: Tract 1 BEGINNING at the Northeast corner of Lot 4, Block 12, Phyllis Wheatley Addition; 'FENCE South, along the East line of Lots 4 and 5, Block 12, said addition, a distance of 95. 39 feet to a point in the East line of said Lot 5; 0 THENCE North 1 451 West, across said Lots 5 and 4, a distance of 9 5. 46 feet to a point in the North line of Lot 4; THENCE East, along the North line of said Lot 4, a distance of 2.91 feet to the PLACE OF BEGINNING. Containing 0.003 acres, more or less. Tract 2 BEGINNING at the Northeast corner of Lot 1, Block 12, Phyllis Wheatley Addition; THENCE South, along the East line of Lots 1 and 2, Block 12, said addition, a distance of 96. 8 feet to the Southeast corner of said Lot 2; 1-' 11 JwF THENCE Westerly, along the South line of said Lot 2, a distance of 4. 39 feet to a point; O THENCE North 1 45' West, across said Lots 2 and 1, a distance of 96. 23 feet to a point in the North line of said Lot 1; 0 THENCE North 83 _58' East, along the North line of said Lot 1, a distance of 7. 37 feet to the PLACE OF BEGINNING. Containing 0. 013 acres more or less. SECTION 2. THAT the owners of said land including VERLENA HERE - FORD, BE offered through the Right -of -Way Department of the City of Lubbock the amount of $150.00, which is the amount appraised as the value and total damages for the acquisition of title to an easement in said City as hereinabove described for the purposes herein stated, for the use and benefit of the City of Lubbock, located in Lubbock County, Texas, and unless accepted forthwith the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the : I�ment title to said land as hereinabove described for public purposes and munit;ipal purposes.
