HomeMy WebLinkAboutResolution - 091478Q - Agreement - Health Department Of COL - TTUSM - 09_14_1978-KJ: hw PV(ZAT.TTTTnW BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an affiliation agreement between the Health Department of the City of Lubbock and the Texas Tech School of Medicine attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Ross, Jr., City Attorney THE STATE OF TEXAS: COUNTY OF LUBBOCK: THIS AGREEMENT MADE AND ENTERED INTO this 14th day of September, 1978, by and between the CITY HEALTH DEPARTMENT of the City of Lubbock, County of Lubbock, 1100 N. Avenue Q, Lubbock, Texas, governed by the City Council of Lubbock, here- inafter called "Health Department", and TEXAS TECH UNIVERSITY SCHOOL OF MEDICINE AT LUBBOCK, by the Board of Regents of Texas Tech University, acting in its capacity as the governing Board of Texas Tech University School of Medicine at Lubbock, hereinafter called "University." WITNESSETH: WHEREAS, the Health Department operates patient -care service programs in various clinical settings, and WHEREAS, the University operates a medical school, and WHEREAS, the Parties desire to advance medical and allied health education and aid in meeting the ever increasing demand in the State and Nation for additional health manpower, and to make available better medical service to patients who are ill, and WHEREAS, it is deemed advisable and to the best interest of the Parties to establish an affiliation for the purpose of carrying out these objectives, NOW, THEREFORE, for and in consideration of the foregoing and in further consideration of the mutual benefits, the Parties hereto agree as follows: 1. Term. The term of this agreement shall begin on the date of its execution and shall continue for an indefinite period provided, however, that either Party shall have the right to terminate the agreement on twelve months written notice to the other Party. 2. Understanding. a. The Health Department will i. Allow the use of its facilities for the training of under- graduate medical education students. ii. Provide access for faculty and students to patients in the patient care programs of the Health Department as part of their clinical training program. iii. Review periodically the specific programmatic efforts and number(s) of students to participate in programs of the Health Department, both factors being subject to mutual agreement of the Signatory Parties. iv. Maintain responsibility for clinic policies and adminis- trative guidelines to be used in the operation of the Health Department. V. Encourage its staff to participate in the educational activities of the University. b. The University will i. Maintain the authority and responsibility for medical education programs for its students which may be conducted within the Health Department programs. ii. Adhere, by its faculty and students, to the Health Department's policies and procedures when in attendance at programs of the Health Department. C. Nothing herein shall be construed so as to require the University to staff the Health Department wholly, nor as to prevent other physicians and personnel (not pursuing a medical education) from being used by the Health Department to offer medical attention and service programs to those in need. 3. Research. It is understood that clinical research programs based at the Health Department may be encouraged in order to strengthen the academic program and will be subject to rules and regulations of the University in developing such programs. This does not mean that the Health Department is prohibited from using programs of its own, not related to the academic program of the University. Research programs will not be initiated prior to approval of Signatory Parties. 4. Amendment. This agreement may be amended in writing to include such provision as the Parties may agree upon. 5. Venue. Venue in any action at law on. equity in relation to and in connection with this Agreement shall be Lubbock County, Texas.
