RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
land for municipal public use and purposes, to -wit: for the Milwaukee Avenue widening
project from 34th Street to 92"d Street; and
WHEREAS, the City Council of said City finds it in the public interest and for
public purposes and municipal purposes to proceed with the acquisition of lands as
needed for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple interest to the tract of land further described
in the attached Exhibit "A", be acquired for public purposes and municipal purposes as
set forth in the preamble hereof.
SECTION 2. THAT the owner of said tract, being the State of Texas, BE offered
through the Right -of -Way Department of the City of Lubbock the amount of $20,000.00,
which is the amount appraised as the value and total damages for the fee simple interest,
for the use & benefit of the City of Lubbock, Texas, for the purposes herein stated; and
Passed by the City Council this llth day of May/J , 2006.

BEING a .0.92 acre tract of land out of Section 36, Block A-K, Lubbock County, Texas, said tract being
part of a tract of land conveyed to the State of Texas by deed from S. E. McMillan and wife dated July
28, 1961 and recorded in Volume $51, Page 68, Deed Records, Lubbock County, Texas, said 0.92 acre
tract of land being more particularly described by metes and bounds as follows:
BEGINNfNG at 3/8" rod, found In the North right-of-way of Spur 327, whence the Southwest comer of
said Section 38 bears South 2°22'38" West, 1862.77 feet and South 87031'42" East, 2337.33 feet, and
whence a concrete monument found in the North line of Spur 327, for the Southeast comer of a tract of
land recorded in Volume 1974, Page 557, Deed Records, Lubbock County, Texas, bears South
84°18'17" East, 688.47 feet, for the Southeast and beginning comer of this tract;
THENCE North 84918'17"" West, along the proposed North right-of-way of Spur 327 and an 'Access
tine", 102.44 feet to a point for a comer of this tract;
THENCE Northwesterty, along a curve to the left and along the proposed North right-of-way of Spur 327
and an "Access Line', an are length of 332.99 feet to a point for a comer of this tract, said curve having a
radius of 2861.82 feet and a chord bearing North 87°38'18" West, 332.80 feet;
THENCE South 89-01'42" 'West, along the proposed North right-of-way of Spur 327 and an °Access
Line", 70.87 feet to a point for Southwest comer of this tract;
THENCE Northeasterly, along the existing North rigWof--way of Spur $27 and a curve to the left, an arc
length of 325.32 feet to a 3/8" rod, found at the Northwest comer of this track said curve having a radius
of 215.00 feet and a chord bearing North 45646'51" East, 295.16 feet;

to a 3/8" rod, found for the Northeast comer of this tract;
THENCE Southeasterly, continuing along the existing North right-of-way of Spur 327 and a curve to the
left, an arc Iength of 326.35 feet to the Point of Beginning, said curve having a radius of 216.00 feet and
a chord bearing South 40044'26" East, 295.91 feet;
