RESOLUTION
WHEREAS, in May of 2003, the City of Lubbock obtained a permanent storm
water pipeline easement and working easement out of Section 5 Block S, Lubbock
County, Texas, from the Texas Department of Criminal Justice to install a storm water
pipe line for the South Lubbock Drainage Improvement Project. Said easement is
recorded in Volume 8348, Page 237 of the Official Public Records of Lubbock County,
Texas; and
WHEREAS, Doug and Penny Wuensche, who lease and farm a portion of Section
5, Block S, Lubbock County have filed a claim for crop damage losses during the 2005
crop year in the above described easement parcel; and
WHEREAS, the City desires to make an offer in settlement of said claim; NOW
THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the owners of the above -described interest in land, Doug and Penny
Wuensche, BE offered through the Right -of -Way Department of the City of Lubbock, the
sum of $13,329.01, which is the amount appraised as the cost of crop damages for the
crop year 2005, including all legal obligations attached thereto, in settlement of their
claim with regard to the easement recorded in Volume 8348, Page 237 of the Official
Public Records of Lubbock County, Texas.
