HomeMy WebLinkAboutResolution - 060878G - Quit Claim Deed - Lubbock GC Associates And Others - Avalon Addition - 06_08_1978th RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock be and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Quit Claim Deed in favor of Lubbock G. C. Associates, a Utah Limited Part- nership, Sam Worley, Sam Rich, John D. Abney and wife, Jane H. Abney, and Tim Hatch and wife, Tommie Ann Hatch, attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Passed by the City Council this STH day of June 1978. D RK WEST, MAYOR ATTEST: Treva Phillips, City SA retary- Treasurer APPROVED AS TO FORM: it QUITCLAIM DEED THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS COUNTY OF LUBBOCK § THAT the CITY OF LUBBOCK, a Home Rule Municipality in the County of Lubbock, State of Texas, for and in consideration of the sum of ONE AND N0/100 ($1. 00) DOLLARS and other good and valuable consideration to it in hand paid by LUBBOCK G. C. ASSOCIATES, a Utah Limited Partnership, SAM WORLEY, SAM RICH, JOHN D. ABNEY and wife, JANE H. ABNEY, and TIM HATCH and wife, TOMMIE ANN HATCH, hereinafter called "GRANTEE", the receipt of which is hereby acknowledged, does hereby by these presents ABANDON, DISCLAIM, RELEASE AND FOREVER QUIT CLAIM unto the said GRANTEE all its right title and interest in and to that certain tract or parcel of land lying and being situated in the County of Lubbock, State of Texas, described as follows, to -wit - All the streets and alleys heretofore abandoned and closed by said City of Lubbock in Tracts "A" through "G" (inclusive) in Avalon Addition to the City of Lubbock, Lubbock County, Texas, are hereby quitclaimed to Lubbock G. C. Associates, a Utah Limited Partnership, an undivided 1/2 interest, and Sam Worley an undivided 1/4 interest, and Sam Rich an undivided 1/4 interest respectively, as abutting owners of Tract "A-1" of Avalon Addition, a replat of Tracts "A" through "G" (inclusive), Avalon Addition to the City of Lubbock, Lubbock County, Texas, and -to John D. Abney, and wife Jane H. Abney, and Tim Hatch, and wife, Tommie Ann Hatch, as abutting owners of Tract "A-2" of Avalon Addition, a replat of Tracts "A" through "G" (inclusive) of Avalon Addition to the City of Lubbock, Lubbock County, Texas. TO HAVE AND TO HOLD the same premises together with all and singular the rights, privileges and appurtenances thereto in any manner belonging unto the said GRANTEE, its successors and assigns forever, so that neither the GRANTOR, City of Lubbock, its successors or assigns, nor any persons claiming under it shall at any time hereinafter, have, claim or demand any right to the title to the aforesaid premises or appurtenances or any part thereof.
