HomeMy WebLinkAboutResolution - 6207 - Interlocal Agreement - City Of Dumas - 02_25_1999Resolution No. 6207 Item No. 22 February 25, 1999 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Agreement by and between the City of Lubbock and the City of Dumas, Texas. Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Si tan ity Attorn AB: cp/CityAtty/Amy/Interlocal-Dumas. res.doc Fcbniary 17, 1999 Resolution No. 6207 Item No. 22 INTERLOCAL COOPERATIVE AGREEMENT February 25, 1999 BY AND BETWEEN THE CITY OF LUBBOCK AND THE CITY OF DUMAS This Agreement entered into this 4L day of , 191,, by and between the City of Lubbock, a Texas Home Rule Municipal Corporation (hereinafter called "City of Lubbock") and the CITY OF DUMAS, a Texas Political Subdivision, (hereinafter called "City of Dumas"). WHEREAS, the establishment of the Southwest to Northwest International Trade Corridor (hereinafter called "the Corridor") has the potential of being an important and viable transportation link by and between Mexico, Canada, and the United States; and WHEREAS, the establishment of the Corridor through the West Texas area could promote economic development for the cities and counties of this area; and WHEREAS, it is necessary to employ an engineering firm to conduct a study (hereinafter called "the Study") to survey the feasibility of establishing the Corridor; and WHEREAS, the parties desire to investigate the feasibility of establishing the Corridor and are willing to fund the Study and any associated administrative expenses. NOW THEREFORE, it is agreed between the parties hereto that: SCOPE OF SERVICE A. City of Dumas Responsibilities: City of Dumas agrees to pay $_ V �l �- which is its proportional share of the expenses by population for the Study. City of Dumas agrees that said funds may be used for the funding of the Study. B. City of Lubbock Responsibilities: City of Lubbock shall provide administrative services associated with the Study including any expenses related to the promotion and lobbying for the Corridor. The City of Lubbock shall also fund its proportional share of funding the Study and other related expenses. II. GENERAL CONDITIONS A. Term The term of this agreement shall be one (1) year from the date of execution. The parties agree that this Agreement may be renewed or extended as may be necessary. B. Responsibility The parties shall be responsible for their own respective claims, actions, suits, charges and judgments whatsoever that arise out of their respective performance or nonperformance of the subject matter called for under this Agreement. C. Amendments City of Lubbock or the City of Dumas may amend this agreement at any time, provided that such amendments make specific reference to this Agreement, and are executed in writing, signed by a duly -authorized representative of both organizations and approved by the City of Lubbock County or City of Dumas City Council if required by law. Such amendment shall not invalidate this Agreement, nor relieve nor release City of Lubbock or City of Dumas from its obligations under this Agreement. D. Revenues The parties agree hereto that all payments made pursuant to this Agreement must be made from current revenues available to each respective party. All revenues received by the City of Lubbock pursuant to this Agreement shall be placed in a special project fund in the City of Lubbock's general multi -purpose account. The City of Lubbock agrees to conduct an annual audit on the funds received pursuant to this Agreement. The status of funding shall be made available for City of Dumas's review. E. Compliance The City of Lubbock agrees to comply with all applicable federal, state and local laws and regulations governing the funs provided under this Agreement. ONES AN J ON ATTEST: ATTE .
