HomeMy WebLinkAboutResolution - 081276A - Equipment_Storage Lot Easement Agreement - LBK Transit Division - 08_12_1976E KJ/ nh RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the MAYOR of the CITY OF LUBBOCK, BE and is hereby authorized and directed to ekecute a EQUIPMENT AND STORAGE LOT LEAS AGREEMENT between the CITY OF LUBBOCK and the LUBBOCK TRANSIT DIVISION OF AMERICAN TRANSIT CORPORATION, attached herewith which shall be spread upon the Minutes of the Council and as spread upon the Minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Senter, Jr., arty Attorney EQUIPMENT AND STORAGE LOT LEASE AGREEMENT STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTNi COUNTY OF LUBBOCK This Agreement entered into between the City of Lubbock, a Home Rule Municipality, hereinafter called "CITY", and Lubbock Transit Division of American Transit Corporation hereinafter called "COMPANY", WITNE SSETH: WHEREAS, the CITY and the COMPANY have heretofore entered into a Lease Management Agreement for the operation of a Mass Transit System within the City of Lubbock, and WHEREAS, the CITY in anticipation of receiving new motor coaches for' such Mass Transit System under UMTA Grant desires to enter 'into a Lease Agreement with the Company for certain equipment and storage lots to be used in conjunction with such operation. NOW THEREFORE: The parties hereto do agree as follows: 1. The term of this lease shall be the same as the Lease Manage, ment Agreement between the parties hereto which is referred to above and any extensions of Amendments thereto unless this Agreement is terminated by either of the parties upon the grounds stated herein. 2. The City leases to the Company one 1976 three-quarter ton Ford pickup truck equipped with air compressor, vehicle identifica- tion No. F25MLC34996 and City of Lubbock identification No. 10-4036, 0001 and a Cyclone Vacuum Cleaner. 3. The City does hereby sublet to the Company the real property leased by the City for the purpose of using it in this Mass Transporta- tion System, the following described property: Lots 6 through 15 (inclusive), Block 220 of the Original Town of the City of Lubbock, Lubbock County, Texas. 4. The above described equipment and property shall be used in aV" cordance with the terms and conditions set out in the Lease Management, Agreement by the parties and the conditions set out in UMTA Agreemef'C TX-0 3 -0016. 5. The Company, as a condition of this Agreement, shall include the above leased equipment and property in their insurance policies in the same amount as their other equipment and property, and shall in addition hold the City harmless in the same manner as set forth in sald Lease Management Agreement. 6. The consideration for the lease of the above stated equipment and property between the City and the Company shall be the performan,'P under the stated Lease Management Agreement.
