HomeMy WebLinkAboutResolution - 070876I - Real Estate Acquisition - Right Of Way Dept - Quirt Avenue - 07_08_1976JW F/ nh RESOLUTION o?00s'940r WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine the public needs, safety, and welfare demands and creates a public necessity for the widening, constructing, reconstructing and expansion and improvement of Quirt Avenue in said City in order to provide better access to the Municipal Airport of said City creating a need for additional right-of-way by said City to accomplish such purposes, and this City Council of said City finds it to the best public interest and for public purposes and municipal purposes to pro- ceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described real estate located in Lubbock County, Texas, be acquired for public purposes municipal purposes as set forth in the preamble hereof, to -wit: A parcel of land containing 0. 225 acre of land, more or less, out of a 1.00 acre tract of land in the South half of the Southwest one -quarter of Section 8, Block A, Lub- bock County, Texas. Said 1.00 acre tract was conveyed to Rosa Ortega Griffis by Carl D. Pulliam and wife, Jo Ann, by Deed dated August 31, 1970 and recorded in Volume 1243, page 583, Deed Records, Lubbock County, Texas. Said 0.225 acre of land is more particularly described by metes and bounds as follows: BEGINNING at a point on the West boundary line of Sec- tion 8, Block A, said point is the Northwest corner of said 1.00 acre tract and bears South 881 4' 29" East, a distance of 5, 280. 00 feet, thence South 1,54' 42" West, a distance of 4, 552. 60 feet from the Southwest corner of Section 10, Block A; said point also being the common boundary line and Southwest corner of a tract of land owned by Shirley Wooten. THENCE South 88 ° 52 18" East along the North property line of said 1.00 acre tract, a distance of 67.84 feet to a point; THENCE South 0 ° 11' 12" West, a distance of 140. 06 feet to a point in the South property line of said 1.00 acre tract; said South property line being the common boundary line with Robert W. Berry. JW F/ nh THENCE North 88 ° 51 18" West along the South property line of said 1.00 acre tract, a distance of 72.06 feet to a point on the West boundary line of Section 8, Block A; THENCE North 1 ° 541 42" East along the North boundary line of Section 8, Block A, a distance of 140.00 feet to the PLACE OF BEGINNING, containing 0. 225 acre of which approximately 0.090 acre is in an existing road. SECTION 2. THAT the owners of said land including ROSA ORTEGA GRIFFIS be offered through the Right -of -Way Department of the City of Lubbock the amount of $1, 302.00, which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate hereinabove described for the purposes herein stated, for the use and benefit of the City of Lubbock, located in Lubbock County, Texas, and unless accept- ed forthwith the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title to said land as hereinabove described for public purposes and municipal purposes.
