RESOLUTION

WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality loca
ted in Lubbock County, Texas, has determined and does hereby determine the
public needs, safety, and welfare demands and creates a public necessity for
the widening, constructing, reconstructing and expansion and improvement of
Quirt Avenue and for drainage purposes as regards said street in said City in
order to provide better access to the municipal airport of said City creating a
need for additional right-of-way for street purposes and an easement for
drainage purposes by said City to accomplish such purposes, and this City
Council of said City finds it to the best public interest and for public purposes
and municipal purposes to proceed with the acquisition of lands as needed for
such purposes as aforesaid; NOW THEREFORE:
E IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to Tract I hereinafter described
is to be acquired for street right-of-way purposes for Quirt Avenue and title
to Tract II hereinafter described is to be acquired for an easement for drain-
age purposes, said Tracts I and II being acquired for municipal purposes and

TRACT I
A parcel of land containing 0. 170 acre, more
or less, out of a 3. 82 acre tract in Section 10,
Block A, Lubbock County, Texas. Said 3. 82 acre
tract was conveyed to Jack McQueen by Charles
L. Sabin by Deed dated June 1, 1971 and recorded
in Volume 1270, Page 699, Deed Records, Lubbock
County, Texas. Said 0. 170 acre tract is more
particularly described by metes and bounds as
follows:
BEGINNING at a point in the East Line of
Section 10, Block A, said point bears South
88' 4' 29" East, a distance of 5, 280. 00 feet,
thence North 1 ° 55' 30" East 1, 155. 00 feet
from the Southwest Corner of Section 10,
Block A;
THENCE North 881 4' 29" West along the
South property line of said 3. 82 acre tract,
a distance of 20. 01 feet to a point;

THENCE North 1* 55' 42" East, a distance
of 17. 92 feet to a point, the beginning of a
5, 674. 5780 foot radius curve to the left,
center of said curve bears North 88° 04' 18"
West, a distance of 5, 674. 5780 feet;
THENCE around said 5, 674. 5780 foot radius
curve, an arc distance of 170.02 feet to a
point, the end of said curve;
THENCE North 0' 12' 42" East, a distance
of 142. 15 feet to a point in the North property
line of said 3. 82 acre tract;
THENCE South 88 ° 4' 29" East along the
North property line of said 3. 82 acre tract,
a distance of 26. 80 feet to a point in the
East line of Section 10, Block A;
THENCE South 1 G 55' 31" West along the
East line of Section 10, Block A, a distance
of 330. 00 feet to the PLACE OF BEGINNING,
containing 0. 170 acre of which 0. 129 acre
is in an existing road.
ABOVE DESCRIBED Tract I is to be acquired
for street right-of-way purposes.
TRACT II
A strip of land 60. 00 feet wide and approxi-
mately 307. 98 feet in length and containing
0.425 acre, more or less, out of a 3. 82 acre
tract owned by Jack McQueen in Section 10,
Block A, Lubbock County, Texas. Said 3. 82
acre tract was conveyed to Jack McQueen by
Charles L. Sabin by Deed dated June 1, 1971,
and recorded in Volume 1270, Page 699, Deed
Records, Lubbock County, Texas. Said 0. 425
acre strip of land is more particularly des-
cribed by metes and bounds as follows:

BEGINNING at a point on the proposed
West right-of-way of Metropolitan High-
way 53, said point bears South 88° 4' 29"
East, a distance of 5, 259. 93 feet, thence
North 1 ° 55' 42" East 1, 172. 92 feet, thence
around a 5, 674. 5780 foot radius curve to
the left, an arc distance of 122. 19 feet from
the Southwest Corner of Section 10, Block A.
Tangent to said curve bears South 01 49' 15"
West, center to said curve bears North
890 10' 45" West, a distance of 5, 674. 5780
feet from the Southwest Corner of Section 10,
Block A;
THENCE North 8811 4' 29" West, a distance
of 308. 94 feet to a point in the West property
line of said 3. 82 acre tract;
THENCE North 11 55' 31" East, a distance
of 60. 00 feet to a point;
THENCE South 88' 4' 29" East, a distance
of 307. 01 feet to a point in the proposed West
right-of-way line of Metropolitan Highway 53;'
THENCE South 0° 12' 42" West along the
proposed right-of-way line of Metropolitan

center to said 5, 674. 5780 foot radius
curve bears North 89° 47' 18" West, a
distance of 5, 674. 5780 feet;
THENCE around said 5, 674. 5780 foot
radius curve, an arc distance of 47. 83
feet to the PLACE OF BEGINNING.
ABOVE DESCRIBED Tract II is to be
acquired for a drainage easement to
drain surface waters from said Quirt
Avenue.

SECTION 2. THAT the owners of said land including Jack McQueen be
offered through the Right -of -Way Department of the City of Lubbock the
amount of the total sum of $4171. 00, being $367. 00 for fee simple title to saic
Tract I and $3804. 00 for title to the drainage easement described as said
Tract II, which is the amount appraised as the value and total damages for the
fee simple title and drainage easement and acquisition of said real estate
hereinabove described for the purposes herein stated, for the use and benefit
of the City of Lubbock, located in Lubbock County, Texas, and unless accepte
forthwith the City Attorney of said City of Lubbock is hereby authorized and
instructed to institute condemnation (eminent domain) proceedings to acquire
he fee simple title to said Tract I and drainage easement described as said
Tract II as hereinabove described for public purposes and municipal purposes
