RESOLUTION

WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality
located in Lubbock County, Texas, has determined and does hereby determinE
the public needs, safety, and welfare demands and creates a public necessity
for the widening, constructing, reconstructing and expansion and improvemen
of Quirt Avenue in said City in order to provide better access to the municipa
airport of said City creating a need for additional right-of-way by said City to
accomplish such purposes, and this City Council of said City finds it to the
best public interest and for public purposes and municipal purposes to proceel
with the acquisition of lands as needed for such purposes as aforesaid; NOW
THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described
real estate located in Lubbock County, Texas, be acquired for public purpose
and municipal purposes as set forth in the preamble hereof, to -wit:
A parcel of land containing 4. 732 acres, more
or less, out of Section 1, Block D-3, Lubbock
County, Texas. Said parcel of land was conveyed
to Zada Beard by Will of G. C. Beard recorded
in the Probate Proceeding 2606. Said 4. 732
acres of land of which approximately 2. 484 acres
are in an existing road, is more particularly
described by metes and bounds as follows:
BEGINNING at a point, the Southwest corner of
Section,l, Block D-3, said point bears South
88' 04' 29" East, a distance of 5, 280. 00 feet
from the Southwest corner of Section 10, Block A;
THENCE North 111 55' 31" East along the West line
of Section 1, Block D-3, a distance of 2, 536. 38
feet to a point in the South right-of-way line of
Farm to Market Highway 2641;
THENCE South 84 ° 04' 3 7" East along the South
right-of-way of Farm to Market Highway 2641,
a distance of 110. 28 feet to a point;
THENCE South 48° 55' 40" West, a distance of
68. 21 feet to a point;

137. 94 feet to a point, the beginning of a
5, 674. 5780 foot radius curve to the left, center
of said 5, 674. 5780 foot radius curve bears
South 88° 041 03" East, a distance of 5, 674. 5780

THENCE around said 5, 674. 5780 foot radius
curve, an arc distance of 170.43 feet to a
point, the end of said 5, 674. 5780 foot radius
curve;
THENCE South 01' 121 42" West, a distance of
828.00 feet to wpoint„the beginning of a
5, 784. 5780 foot radius curve to the right, center
of said 5, 784. 5780 foot radius curve bears
North 89 ° 471 18" West, a distance of 5, 784. 5780
feet;
THENCE around said 5, 784. 5780 foot radius curve,
an arc distance of 173. 31 feet to a point, the end
of said 5, 784. 5780 foot radius curve;
THENCE South l 5.51 42" West, a distance of
1, 172. 91 feet to a point in the South line of
Section 1, Block D-3;
THENCE North 88° 04' 29" West along the South
line of Section 1, Block D-3, a distance of 89.93
feet to the PLACE OF BEGINNING.
SECTION 2, THAT the owners of said land including Zada Beard be
ffered through the Right -of -Way Department of the City of Lubbock the amow
f $20, 283. 00, which is the amount appraised as the value and total damages
)r the fee simple title and acquisition of said real estate hereinabove describ
>r the purposes herein stated, for the use and benefit of the City of Lubbock,

ttorney of said City of Lubbock is hereby authorized and instructed to insti-
ite condemnation (eminent domain) proceedings to acquire the fee simple
