HomeMy WebLinkAboutResolution - 061076H - Real Estate Acquisition - Right Of Way Dept - Quirt Ave Municipal Airport - 06_10_1976JW F/ nh RESOLUTION P' , z Q:¢/07¢ //I WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby deter- mine the public needs, safety, and welfare demands and creates a public necessity for the widening, constructing, reconstructing and expansion and improvement of Quirt Avenue in said City in order to provide better access to the Municipal Airport of said City creating a need for additional Right -Of -Way y said City to accomplish such purposes, and this City Council of said City finds it to the best public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. That the fee simple title to the following described real estate located in Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the -Preamble hereof, to -wit: A parcel of land containing 4.076 acres, more or less, outofthe North z of Section 8, Block A, Lubbock County, Texas. Said North z Section was conveyed to Evelyn Ashby Williams and Maurine Ashby by J. H. Beard by proof of heirship recorded in Volumes 57 and 616, Pages 618 and 208 and by Warranty Deed dated September 30, 1973 and recorded in Volume 1360, Pages 468 and 470, Deed Records of Lubbock County, Texas. Said 4.076 acres of land is more particularly described by metes and bounds as follows: BEGINNING at ,the Northwest corner of Section 8, Block A, said Section corner bears South 88 ° 4t 29" East, a distance of 5, 280.00 feet from the Southwest corner of Section 10, Block A; THENCE South 880 41 29" East along the North line of Section 8, Block A,, a distance of 89. 93 feet to a point; THENCE South l° 55t 42" West, a distance of 319.89 feet to a point, the beginning of a 5, 784. 5780 foot radius curve to the right, center to said curve bears North 88 ° 4' 18" West, a distance of 5, 784. 5780 feet; r.I F/nh THENCE around said 5, 784.5780 foot radius curve, an arc distance of 163.22 feet to a point, the end of said curve; THENCE South 3° 321 42" West, a distance of 1, 237.52 feet to a point, the beginning of a 5, 674. 5780 foot radius curve to the left, center of said curve bears South 86 ° 272 18" East, a distance of 5, 674. 5780 feet; THENCE around said 5, 674. 5780 foot radius curve, an arc distance of 161.77 feet to a point, the end of said curve; THENCE South 10 541 42" West, a distance of 795.23 feet to a point in the South property line of said Williams, Ashby tract; THENCE North 88 ° 51 18" West along the South property line of said Williams, Ashby tract, a distance of 49.91 feet to a point in the West line of Section 8, Block A; THENCE North 1° 50 42" East along the East line of Section 8, Block A, a distance of 2, 677. 10 feet to the place of beginning, containing 4.076 acres of which ap- proximately 2. 277 acres are in an existing road. SECTION 2. That the owners of said land including EVELYN ASHBY WILLIAMS be offered through the Right -of -Way Department of the City of Lubbock the amount of $8096.00, which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate hereinabove described for the purposes herein stated, for the use and benefit of the City of Lubbock, located in Lubbock Count3 Texas, and unless accepted forthwith the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title to said land as hereinabove described for public purposes and municipal purposes.
