RESOLUTION

WHEREAS, the CITY OF LUBBOCK has determined that the public
needs, necessity, safety and welfare demand that its public street, to -wit:
Avenue H, be further expanded, extended, and improved in order to pro-
vide a better public road for its inhabitants, which is a public purpose
and a lawful municipal purpose, including the CITY OF LUBBOCK acquiring
lands needed for such public purpose; and
WHEREAS, the CITY COUNCIL of the CITY OF LUBBOCK hereby
determines that it would be and will be to the best public interest and for
public and municipal purposes to proceed with the acquisition of lands as
needed for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described
real estate located in Lubbock County, Texas, be acquired for municipal
purposes and public use and purposes as set forth in the preamble hereof,
to -wit:
The East 52. 25 feet of Lots 4, 5, 6 and 7, Block 7,
Liff Sanders Addition to the City of Lubbock, Lubbock
County, Texas.
SECTION 2. THAT the owners of said land, including DEWEY
ERVIN, be offered through the Right -of -Way Department of the CITY
OF LUBBOCK the amount of THIRTEEN THOUSAND FIVE HUNDRED
SIXTY-NINE AND N0/100 DOLLARS ($13, 569. 00), which is the amount
appraised as the value and total damages for the fee simple title and
acquisition of said real estate hereinabove described for the purposes
herein stated, for the use and benefit of the CITY OF LUBBOCK, and
unless accepted, the CITY ATTORNEY is hereby authorized and instructed
to institute Condemnation Proceedings to acquire fee simple title to said
real estate as hereinabove described for the purposes aforesaid.
