RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, a Letter of Award for
trenching, boring and excavation services for Lubbock Power and Light and Traffic
Engineering — annual pricing, by and between the City of Lubbock and H. D. Weaver
Ditching Service, Inc. of Lubbock, Texas and related documents. Said Letter of Award is
attached hereto and incorporated in this resolution as if fully set forth herein and shall be
included in the minutes of the City Council.

Dear Ms. Malone:
H.D. Weaver Ditching Service, Inc. has been awarded the items noted in your bid forms
Exhibit A and Exhibit B attached for Trenching, Boring, and Excavation Services for Lubbock
Power and Light and Traffic Engineering - Annual Pricing as the rip mart/ supplier based on your
response to the City of Lubbock Invitation to ITB #227-02/RS.
1. A Work Order will be issued by the City of Lubbock and covers the category of items
shown below, and no other, during the period beginning November 21, 2002 and
ending November 20, 2003. The City of Lubbock shall not be responsible for
payment of any invoices except those orders placed pursuant to this agreement.
2. Category of Items:
As per your attached Exhibit A and Exhibit B
3. H.D. Weaver Ditching Service, Inc. bid dated October 31, 2002, is incorporated into
and made a part of this agreement.
4. Prices: As quoted.
5. All invoices shall be directed to:
City of Lubbock

6. The City of Lubbock reserves the right to enforce the performance of this contract in
any manner prescribed by law or deemed to be in the best interest of the City of
Lubbock in the event of breach or default of this agreement. The City of Lubbock
reserves the right to terminate this agreement with a thirty (30) day written notice in
the event H.D. Weaver Ditching Service, Inc. fails to perform in accordance with
their proposal dated October 31, 2002.
