Senter, Jr., Attorney a CITY COUNTY LIBRARY AGREEMENT STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK § THIS agreement entered into between the Commissioner's Court of Lubbock County, Texas, acting by and through its duly authorized County Judge hereinafter called County and the City of Lubbock acting by and through its duly authorized Mayor hereinafter called City. WITNESSETH WHEREAS the County of Lubbock and the City of Lubbock have cooperated for many years in providing library services to the citizens of the City and County of Lubbock and it is their desire to continue such cooperation by providing for the shar- ing of expenses in such Library System Operation. City, except as otherwise provided herein, shall have sole control, administration, and direction over the library department, which shall continue as a department of the City, and over the systems employees. A joint library board, consisting of five (5) City appointees and four (4) County appointees, shall continue in its advisory capacity to make recommendations to the City Council, County Commissioner's Court, and the Library Director. The City of Lubbock and County of Lubbock do hereby agree to share the expenses of such library operation upon the following terms and conditions: 1. The City shall annually, on August 1st, provide the County with the. preliminary budget estimates of the operations of the Library De- partment for the fiscal year then under consideration. The County agrees to advise the City of its acceptance or rejection of. the pro- posed budget by not later than September 1st of each year. In the event County rejects the budget estimate as proposed by City and an agreement is not reached by September 15th, City shall have the option to begin arrangements to terminate joint library services. 2. The County agrees to pay 4016 of the net Library Department expend- itures and encumbrances after deducting library revenues. The City shall render a statement monthly to the County setting out the net operations of the library as described above. City will render a final statement of net operations to County after the -close of the City's fiscal year and after audit, adjustments have been posted. The County agrees to pay City within twenty (20) days of receipt of such monthly and year end statements. 3. The County agrees to participate, without prior approval and according to the formula set out above, in net library expenditures and encum- brances in an amount up to five percent (5°jo) greater than the total amount budgeted by the County as agreed to in paragraph 1 above. - ._'d. As a part of the considerktion for the services to be rendered by the City hereunder, all books and other library equipment, ` including all equipment presently used in the library system, now owned by the Library Department shall continue to be pro- perty of and vest in the City, and further, all books and other library equipment to be purchased by the Library Department shall become the property of and vest in the City. This agreement shall be for the City's fiscal year, which began October 1, 1976, and shall continue for each fiscal year period thereafter until otherwise terminated as set forth above. This contract shall continue in full force and effect until such time as the parties hereto shall mutually agree, by written resolution, to terminate it, provided however, City or County may terminate this contract by giving six (6) months' written notice of intention to do so to the other party.
