DOT-FA76SW-8149 BE IT RESOLVED by the governing body of the City of Lubbock,,Texas, (hereinafter termed "City"): SECTION 1. That the City of Lubbock, Texas, shall and it does hereby accept Amendment No. 1 to Grant Agreement, Contract No. DOT- AAX9 FA76SW-8149, as authorized by the Chief, Albuquerque Airports District Office, Southwest Region,.Federal Aviation Administration, transmitted by letter dated F E B 2 4 1977 , that said City does hereby accept all the terms, conditions, and obligations therein and thereby imposed and by its acceptance of same does hereby acknowledge such instruments as constituting a solemn and binding agreement with the United States Government, for the purpose of obtaining Federal aid in the development of the Lubbock Regional Airport, and that such agreement shall be as set forth hereinbelow. SECTION 2. That the Mayor of the City of Lubbock, Texas, is hereby authorized and directed to evidence said City's agreement by affixing his signature to such agreement, which is hereby executed in sextuplicate, and the City Secretary -Treasurer is hereby authorized to impress the official seal of Lubbock, Texas, thereon and to attest said execution. SECTION 3. That the Amendment No. l to the Grant Agreement referred to hereinabove shall be as follows: UNITED STATES OF AMERICA DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION Page 1 of 2 pages Contract No. DOT-FA76SW-8149 Lubbock Regional Airport Lubbock, Texas AMENDMENT NO. 1 TO GRANT AGREEMENT FOR PROJECT NO. 6-48-0138-08 WHEREAS, the Federal Aviation Administration, successor to the Federal Aviation Agency (hereinafter called "FAA") has determined it to be in the interest of the United States of America that the Grant Agreement between the FAA, acting for and on behalf of the United States, and Lubbock, Texas, (hereinafter called Sponsor), accepted by said Sponsor on the 24th day of September, 1976, relating to the Lubbock Regional Airport, Lubbock, Texas, Project No. 6-48-0138-08, be amended as hereinafter provided. NOW THEREFORE WITNESSETH: That in consideration of the benefits to accrue to the parties hereto, the United States of America on the one part, and the Sponsor, on the other part, do hereby mutually agree that the said Grant Agreement shall be and hereby is amended as follows: Overlay a portion of Runway 17R/35L; relocate ILS-ALS; relocate utilities; construct, mark, and light Phase I of Runway 17R/35L and parallel taxiway extension.
