Passed by the City Council this loth day of 1977• ROY 18ASS, MAYOR ATTEST: Treva Phillips, Ci Secretary -Treasurer APPROVED AS TO FORM: r, Jr. , ity Attorney RESOLUTION ACCEPTING THE PROVISIONS OF STATE HIGHWAY COMMISSION MINUTE ORDER THE STATE OF TEXAS Lubbock , , Texas CITY OF LUBBLOCK February 10 , 19 77 MOTION was made by Councilwoman Jordan and seconded by Councilman West that the Lubbock City Commission accept the provisions contained in Minute Order No. 72153 passed by the State Highway Commission on 19 77, for the improvement by the Texas Highway Department of the roads described below and that the City of Lubbock agrees to the provisions contained therein : State Highway 116 from Raleigh Avenue, East to the Atchison, Topeka and Santa Fe Railroad, a distance of approximately 0,4 mile. VOTE on the motion was as follows: Mayor Bass, Councilmen West, Jordan, Henry and McAlister voting Yea, none voting Nay. Provide for reconstruction of Grading, Structures and Surfacing at An estimated cost of $246,000 as authorized in the 1977-1978 Urban System Program. 3, riaintain that portion of the work which is its responsibility in accordance with present maintenance agreement. Upon acceptance of.the provisions of this Order by the appropriate officials of the City of Lubbock, the Engineer -Director is directed to enter into any necessary agree meuts with the City covering the details of the proposed improvements, to proceed with the engineering development of the project and after the City has fulfilled.its responsibilities, to proceed with construction in the most feasible and economical moaner, it is understood that the City may discharge its construction obligations as outlined herein in any manners as it may elect. In the event the City desires the State to in- clude its portion of the work in the State's construction contract, the Engineer - Director is hereby authorized to enter into.agreement with the City for such work and its cost as may be agreed upon. Count -------------------- -- Y Page --I of 2 pages District No. WIMREAS, in LUBBOCK COUViR, the City of Lubbock has requested assistance in reconstruc- tion on State Highway 116 from Raleigh Avenue, East to the Atchison, Topeka and Santa Fe Railroad, a distance of approximately 0.4 mile; and WIM EAS,, State Highway 116 is included in the Urban System; :and VTP X,AS, it is the desire of the State Department of Highways and Public Transportation to assist the City of Lubbock in such work; 11als THEREFOP.E, the Engineer -Director is -directed to tender the following proposal to the City of Lubbock: Provided the City will: 1. Provide for the adjustment of utilities, the construction: of storm sewers, drive- ways and sidewalks, all as may be required and all in accordance with governing policies and regulations of the Department. 2. Maintain that portion of the work which is its responsibility in Accordance with present maintenance agreement and agree to regulate traffic, prohibit parking and prevent encroachment on the right of way, all in accordance with governing policies and regulations of the Department. Subject to the availability of Federal -aid Urban System funds and the eligibility of the proposed work for financing with said funds„ the State Department of Highways and Public Transportation will: 1. This Minute Order requires acceptance by the City of Lubbock within 90 days of the date of the Minute Order or the action contained therein shall be automatically canceled.
