THAT the Mayor of the City of Lubbock BE and is hereby authorized and
drected to accept for and on behalf of the CITY OF LUBBOCK the provisions

struction at the intersection of State Highway 116 and U. S. Highway 62; and

and
WBL-Tm S, it is the desire of the State Department of Highways and Public Transportation
to assist the City of Lubbock in.such work; _
110W,. 'i'MWORE, the Engineer -Director is directed to tender the following proposal
to the City of Lubbock:
Provided the City will:
1. Provide for the adjustment of utilities and the construction of continuous
curb and gutter and storm sewers as m=y be required, all in accordance with
governing policies and regulations of the Department.
2. Yaintain that portion of the work which is its responsibility in accordance
with present maintenance agreement and agree to regulate traffic, prohibit
parking and prevent encroachment on the right of way,. all in accordance with
governing policies and regulations of the Department.
Subject to the availability of Federal -aid Urban System funds and the eligibility of
the proposed work for financing with.said funds, the State Department of Highways and
Public Transportation will:
1. Prepare construction plans and specifications.

MOTION was made by Councilwoman Jordan and seconded by Councilman
West that the Lubbock I City Commission accept the
provisions contained in Minute Order No. 72� passed by the State
Highway Commission on Tnnna= 20 19=, for the improvement
by the Texas Highway Department of the roads described below and that
the City of Lubbock agrees to the provisions contained
therein:
At the intersection of State Highway 116 and U. S. Highway
62.
VOTE on the motion was as follows:
Mayor Bass, Councilmen West, Jordan, Henand mckliater voting
Yea, none voting.Nay.

2. Provide for widening;, and reconstruction of Grading, Structures and Surfacing
at an estimated cost of $90,000 as authorized in the 1977-1978 Urban System
Progrzm.
3. Maintain that portion of the work which is its responsibility in accordance
with present maintenance agreement. .
Upon acceptance -of the provisions of this Order by the appropriate officials of the
City of Lubbock, the Engineer -Director is directed to enter into any necessary agree-
ments with the City covering the details of the proposed improvements, to proceed
with the engineering development of the project and after the City has fulfilled its
responsibilities, to proceed with construction in the most feasible and economical
manner.
It is understood that the City may discharge its construction obligations as out-
lined herein in any wanner as it may elect. In the event the City desires the State
to include its portion of the work in the State's construction contract, the Engineer
Director is hereby authorized to enter into agreement with the City for such work and
its cost as may be agreed upon.
This Order shall become operative upon acceptance by the City of Lubbock and if not
accepted within 90 days of the date hereof, the action herein contained shall be auto-
matically cancelled.

It is with pleasure that we transmit for your information, action and
files a copy of Highway and Public Transportation Commission Order No.
72152, dated January 20, 1977, regarding reconstruction in the city of
Lubbock on the following:
At the intersection of State Highway.116 and U. S. Highway 62.
This Minute Order requires acceptance by the City of Lubbock within
90 days of the date of the Minute Order or the action contained therein
shall be automatically canceled.
For your convenience, we are enclosing three copies of a suggested reso-
lution to be passed by the City Council of Lubbock. Please return two
certified copies of this resolution to our office here in Lubbock for
further handling.
Your cooperation in the development of an adequate system of highways
for your area is sincerely appreciated.
