RESOLUTION
E IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
irected to accept for and on behalf of the CITY OF LUBBOCK the provisions
ontained in Minute Order No. 72154 of the Texas Highway and Public Trans
ortation Commission regarding reconstruction on Farm to Market Road 1730
rom Loop 289, South a distance of approximately 1. 1 miles, attached here-
with which shall be spread upon the minutes of the Council and as spread upon
e minutes of this Council shall constitute and be a part of this Resolution as
if fully copied herein in detail.

tion on Farm to Market i:oad 1730 from Loop 289, South -a distance of approximately 1.1
miles; and
IIi:EM=, Farm to Market Road 1730 is included in the Urban System; and
Z,MMAS, it -is the desire of the State Department of highways and Public Transportation
to assist the City of- Lubbock in such worst;
NOW, TIM-RLEOPM.1 the Engineer -Director is directed to tender the follo%Ang proposal to
the City of Lubbock:
Provided the City will.:
1. Furnish all required right of way clear of obstructions with acquisition proce-
dures to be in accordance with applicable Federal and State laws governing the
acquisition policies for acquiring real property.
2. Provide fcor.the adjustment of utilities, the construction of continuous curb
' and gutter, storm sewers, driveways and sidewalk, all as may be required and
all in accordance with governing policies and regulations of the Department.
3. Maintain that portion of the work which is its responsibility in accordance
v.zith present w.intenance agreement and agree to regulate traffic, prohibit park—
ing and.prevent eac:.oachment on the right of way, all in accordance with gov—
erning policies and regulations of the Department.

Subject to the availability of Federal -aid. Urban System funds and the eligibility of
the proposed work for financing with said funds, the State Department of Highways and
Public iraasporta.tion will:
1. Prepare construction plans and specifications.
2. Provide relocation assistance as pay be required and determined to be eligible
under the Relocation Assistance Program at an estimated cost of $500.
3. Provide for reconstruction of Gradiug, Structures and Surfacing at an estimated
cost of ,641,500 as authorized in the 1977-1978 Urban System Program.
4. Maintain that portion of the work which is its responsibility in accordance with
present =Intenance agreement.
Upon acceptance of the provisions of this Order by the appropriate officials of the
City of Lubbock, the Engineer -Director is directed to proceed with the Relocation
Assi-£.tance Program, to enter into any necessary agreements, with the City covering the
details of the proposed•im2rovements, to proceed with the engineering development of
the project and after the City has fulfilled its responsibilities, to proceed with con-
struction in the most feasible and economical. manner.
It is understood that the City racy discharge its construction obligations as outlined
herein in any manner as it may elect. In the event the City desires the State to in
elude its portion of thee:*ork in the State's construction contract, the Engineer -
Director is hereby authorized to enter into agreement with the City for such 1work and
its cost as may be agreed upon.
This Order shall become operative upon acceptance by the City of Lubbock and if not
accepted within 90 days of , the date hereof, the action . herein contained shall be auto-
matically ca=elled. _

Dear Mr. Cunningham:
It is with pleasure that we transmit for your information, action and
files a copy of Highway and Public Transportation Commission Order No.
72154, dated January 20, 1977, regarding reconstruction in the city of
Lubbock on the following:
Farm to Market Road 1730 from Loop 289, South a distance of
approximately 1.1 miles,
This Minute Order requires acceptance by the City of Lubbock within
90 days of the date of the Minute Order or the action contained therein
shall be automatically canceled.
For your convenience, we are enclosing three copies of a suggested reso-
lution to be passed by the City Council of Lubbock. Please return two
certified copies of this resolution to our office here in Lubbock for
further handling.
Your cooperation in the development of an adequate system of highways
for your area is sincerely appreciated.
