RESOLUTION
IBE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the CITY OF LUBBOCK BE and is hereby author-
ized and directed to execute for and on behalf of the City of Lubbock an
AGREEMENT between the City of Lubbock and the STEERING COMMITTEE
OF THE LUBBOCK URBAN TRANSPORTATION STUDY covering work per-
formed in the FY1976 Unified Work Program, attached herewith which shall
be spread upon the mim tes of the Council and as spread upon the minutes of
this Council shall constitute and be a part of this Resolution as if fully copied
herein in detail.

THIS CONTRACT, entered into this 23rd day of - October , 1975,
by and between the Steering Committee of the Lubbock Urban Transportation Study
(Metropolitan Planning organization), hereinafter referred to as the 'WO" and the
City of Lubbock, Texas, hereinafter referred to as the "City".
WITNESSETH
WHEREAS, on September 2, 1975. the MPO entered into a contract with the State
of Texas, acting by and through its Engineer -Director of the State Department of
Highways and Public Transportation, hereinafter referred to as the "State", for the
purpose of.assuming responsibility for work items to be financed through Section 112
of the Federal -Aid Highway Act of 1973 in support of the Urban Transportation
Planning Process established pursuant to Section �34 of Chapter 1, Title 23, United
States Code; and,
WHEREAS, it is the intention of the MPO'to make available to.the City, the
.Section 112 funds provided to them through the aforementioned contract of
•1975, in payment for work performed by .the City in maintaining and updating the basic
study elements of the Section 134 planning process'as outlined in the FY 1976
Lubbock Urbanized Area.Unified Work Program, the applicable portion of which is
marked Exhibit "A" attached hereto and made a part hereof;
NOW, THEREFORE, the MPO and the City -in consideration of the premises and the
mutual covenants and agreements of the parties hereto, to be by them respectively
kept and performed, as hereinafter set forth, it is agreed as follows:
I. The City agrees to assume responsibility for the specific planning work
items assigned to it and authorized by the Steering Committee of the Lubbock Urban
Transportation Study in its adoption of the FY 1976 Unified Work Program.
II. The MPO will reimburse the City for authorized cost incurred by the work
tasks and line items as listed in Exhibit "B" in accordance with Federal Procurement
Regulations Part 1-15. Costs incurred subsequent to receipt of a written work order
from the State through the MPO and properly supported will be reimbursable. The
total reimbursement by the MPO 3s not to exceed $65,446. The MPO will make payments
to the City as partial payments based upon properly prepared billing summarizing all
authorized costs by classification of ',costs showing description, quantities, price
extension, and total. Such payments shall be made no more frequently than on a
monthly basis. From the amount due, the MPO will withhold five (5) percent pending
completion of the work performed under the terms of this Contract. The City shall
submit a final voucher and a recapitulation of all previous billings for the contracted
work within ninety (90) days of the close of this Contract. Prior to final payment,
an audit of the records supporting the costs claimed by the City shall be made. The
audit will be in accordance with standard State procedures. The City shall make
available records for said audit to authorized representatives of the State and Federal
agencies involved. The City shall bear responsibility for all funds determined to be
ineligible for Federal reimbursement and shall refund to the MPO such funds in excess
of the five (5) percent retainage. All fiscal 'records relating to work for which
reimbursement is made shall be maintained by the City for three (3) years after final
payment from the MPO.
IIl. When specific planning work is to be accomplished by the use of consultants,
an agreement between the City and the consultant shall be submitted to the -State through
the 14P0 for approval by the State and Federal Highway Administration prior to execution.
The use of qualified minority consultants by the City is encouraged.If the City
subcontracts for specialized services such as printing and aerial photography, the
,City will first have received the written approval for such work from the State.
IV. A reasonable number of copies of all information, reports, proposals,
brochures, summaries, written conclusions, graphic presentations, and similar
materials developed by the City and/or its consultants and financed in whole or in
part;as provided herein, shall be submitted to the State for review and concurrence
and shall have the approval of the Steering Committee and the Policy Advisory Committee
prior to its official public release, presentation, dissemination, publication, or
other distribution. Official submissions to Federal agencies shall be made by the
State to the Federal Highway Administration.
All official reports published by the City as a result of this project shall
contain an acknowledgment as follows:
"Prepared in cooperation with the U.S. Department of Transportation,
Federal Highway Administration."
Further, for reports prepared for distribution to the public, a disclaimer state-

ment as follows will be included;
"The contents of this report reflect the views of the City which is
responsible for the facts and the accuracy of the data presented
herein. The contents do not necessarily reflect official views or
policies of the State Department of Highways and Public Transpor-
tation or the Federal Highway Administration."

No material produced in whole or in part under this Contract shall be subject
to copyright.
Vr The State, Federal Highway Administration, and. other appropriate govern-
mental agencies shall be accorded proper facilities for review and inspection of the
work provided for herein and shall at all reasonable times have access to the premises,
to all books, records, correspondence, instructions, receipts, vouchers, and memoranda
of every description pertaining to the work. All reviews and inspections by other
than participants will be arranged for through the MPO by the State.
VI. Any line item of work presented for reimbursement by the City which is not
included in the line -item table, Exhibit "B", must have prior approval of the MPO, the
State, and the Federal Highway Administration.
VII. The City and/or its contractors will comply with all Federal, State, and
local laws, statutes, ordinances, rules, and regulations, and the orders and decrees
of any court or administrative bodies or tribunals in any matter affecting the perfor-
mances of this Contract, including without limitation workman's compensation laws,
minimum and maximum salary and wage statutes and regulations. When required, the City

shall furnish the State, through the MPO, with satisfactory proof of its compliance
therewith.
VIII._ it is mutually agreed that all parties hereto shall be bound by the pro-
visions of Title 49, Code of Federal Regulations, Part 21, which was promulgated to
effectuate Title VI of the Civil Rights Act of 1964. In furtherance of the require-
ments of Title 49, a copy of."Notice to Contractors - Compliance with Title VI of the
Civil Rights Act of 1964 for Federal -Aid Contracts" is marked Exhibit "C" attached
hereto and made a part hereof.
I%. The City will save harmless the MPO, State, and Federal Highway Administration
from all claims and liability due to its negligent acts or the negligent acts of its
subcontractors, agents, or employees during the course of this work.
X. Any alterations, extensions, supplements, or modifications of the terms of
this Contract as detailed herein or as outlined in Exhibits "A" and "B" shall be. agreed
to in advance and in writing by the Parties hereto and the State and Federal Highway
Administration.
XI., This Contract shall terminate upon completion of a final audit and receipt
of a final payment for the work performed under the terms of this Contract. In the
event the work performed under this Contract has not been satisfactorily concluded by
August 31, 1976, this Contract shall terminate and any funds remaining shall be
carried over into a contract to be executed between same Parties on or about September 1,
1976. Further, either Party may terminate its interests and obligations under this

Contract prior to this termination date in the event of an unresolvable dispute or
other reason by giving five (5) days notice in writing to the other Party. Upon ter-
mination for any reason, all records pertaining to work covered by this Contract shall
be retained as specified in Item II hereof and payment for the work or services per-
formed will be made through the date of termination.
IN WITNESS WHEREOF, the Parties hereto have caused these presents to be executed
on the aforementioned date.

TASK 5.0 (FY 1975 - CARRIED OVER TO FY 1976) UNIFIED WORK PROGRAM, CAPACITY -
STUDY OF INTERSECTIONS
Proposed Work: Continued study and analysis of capacities of intersections
(Seven intersections from FY 1975 Unified Work Program and twelve intersections
from FY 1976 Unified Work Program) to determine results of improvements and
changing conditions.
Previous Work: A rather brief study was made in 1974 for the Level 2
Review of the Lubbock Urban Transportation Plan. Two projects-under.the TOPICS
program have greatly improved the signalizat`ion of 133 intersections: These
f .
programs and other improvements make the reappraisal of certain existing inter-
section capacity data advisable.
Method: This study will utilize field data (traffic counts, turning
movements, truck traffic and other) and office data (theoretical capacities
and level of service).
Product: Printed report with tables.

TASK 3.0: ACCIDENT STUDY (Including TASK 4.0, ACCIDENT STUDY, CARRIED OVER
FROM FY 1975)
Proposed Work: Continuing study of traffic accidents on Lubbock streets;
Trincipally, but not entirely limited to those accidents on major thoroughfares.
Previous Work: An accident study was done in preparing the Level 2 Review• .,
of the Lubbock Urban Transportation Plan. This study used and compared 1963
and 1970 data.

24ethod: -Record total 1974 accidents and�tctal 1975 accidents at those
Intersections and street and roadway sections requested by the Steering
Committee of the Lubbock Urban Transportation Study. Compute accident rates
--per 20,000,000 vehicles entering the intersections and per 10,000,000 vehicle
-miles along control sections and street sections using traffic counts which
-will be taken in the Spring of 1976.

BASK 5.0: TRAFFIC ACCIDENT ANALYSIS AND INTERSECTION IMPROVEMEW PLAN
Proposed Work: The development of a recommended traffic accident analysis
.-and intersection improvement plan.
-Previous Work: In the`1965 Lubbock Urban.Transportatioa Plan, traffic
accident experience was analyzed, accident rates computed,:and improvements
zecommended. Since that time, many improvements have.been implemented,'traffic
pattern shifts observed, and continued accidents recorded. Continued
:-surveillance of accident data has been accomplished by the City of Lubbock
`Traffic Engineering Department. However, an updated indepth analysis of recent
accident experience has not been conducted.
Method: The following principal tasks will be undertaken:
1. Accident rates in terms of accidents per 20,000,000 entering vehicles,
:end roadway section accident rates in terms of accidents per 10,000,000
w••vehicle miles will be provided. Identify roadway sections and inter-
-sections,to be included in the analysis on the basis.of decreasing
=severity.. This will basically be the network of: urban freeways,
arterials, and collector streets made up of both designated routes
-.and other connecting roadways.
i :2. For the roadway network so identified, -data will be assembled and
-tabulatedfor:
1974 traffic accident experience at intersections and along
roadway sections.:
Current traffic volumes and flow data.

3. Assemble geometric data for the selected study locations.
k. Examine study locations and formulate recommended improvements for
each. This indepth examination will include:
- On -site observation of operation.
- Analysis of collision diagram.
Review of design characteristics.
Product: A printed report in booklet form consisting of (1) Recommended
Improvements for each site presented in narrative and schematic form.. Such
-Improvements will be expected to range from low-cost measures such as parking
restrictions to full scale reconstruction. ''(2) An implementation plan to

guide the accomplishment of improvements This plan will consider the need
to group similar projects, the dependency of one improvement on another, and
will present estimated costs and relative priorities,
Responsible Agency: The primary responsibility for completion of the
proposed work rests with the City of Lubbock. Performance of tasks -is antici-
pated to be accomplished by a consultant with the support and involvement of
the City of Lubbock and its Traffic Engineering staff.

in Washington, D.C., November 3-7, 1975.
Previous Work: This is a new item for the Lubbock Urban Transportation
Study. ;
Method Send three persons to the above listed course. Selection to
be approved by the Steering Committee of the Lubbock Urban Transportation Study.

Proposed Work The development of a complete street inventory for the
City�of Lubbock. The inventory will provide the following information for
the entire street system. '

.2. Street width (indicating curb and gutter)
3. Type of surface
4. Type of base
5: Side walk notation
Previous Work: "In the 1965 Lubbock Urban Transportation Plan, the
Lubbock Street and. Highway System was established and has been recently.
-updated as a part of the Level 2 Major Review.
Method: The total inventory would be accomplished in three phases
8.1 (Phase I).would cover the five proposed work items listed
above.'for that portion of the system designated as arterial.
8.2 (Phase II) would cover the five proposed work items listed
above for"that portion .of the.system designated as collector.
8.3 '(Phase III) would cover the five proposed work items listed
above for that portion of the system designated as residential.
-Product: 8.1 (Phase I)•results will be a computer program that will provic
a complete inventory of the arterial portion of the City -of -Lubbock Streets
System, within the city limits.

TASK 1.0: RURAL LAND USE
Proposed Work: Conduct a Land Use Study covering the area between the
Lubbock City Limits and the Intensive Study Area limits.
Previous Work: A complete land use survey within the existing city limits
was first made in 1958 and has been continuously updated since that time. In
1964, a new.land use survey was made to determine the land use within the
Intensive Study Area which extends about five miles beyond the city limits.
In 1971, a complete land use survey of Lubbock Comprehensive Plan, entitled
"Land Use", and the "Land Use" chapter of the Level 2 Review of the Lubbock
Urban Transportation Study are both based largely on data from the 1971 survey.
• Very little has been done to update the land use outside the city limits,
within the'Intensive Study Area, since 1971.
Method: Field survey, utilization of city building permits, aerial photo-
graphy, tax records and other data.
Product: An updated color -coded land use map and current computer land
use file.

TASK 2.0: UPDATING SOCIAL, ECONOMIC AND ENVIRONMENTAL CONSIDERATIONS
Proposed Work: Continuing updating of social, economic and environmental
considerations.
Previous Work: An intensive study financially aided by a Federal grant
from the Renewal Assistance Administration of the Department of Housing and
Urban,Development, with results and recommendations, was published in 1973.
The first of the two published volumes, The Need for Community Renewal in Lubbock,
is a summary document of many Community Renewal Program (CRP) work elements on
housing,.economics, the environment, citizen participation, and goals. The
second volume, The Plan of Action, determines priorities and makes recommen-
dations for improving problem areas.
Method A method for the maintenance of an updated CRP has been established.
The city's land use data file, which contains a parcel by parcel listing of all
structural conditions, environmental deficiencies and land use types, is an

excellent cornerstone upon which to build the updating process. Extracts from
this data file, for which the city has outlined updating procedures, shall be
utilized to determine current social, economic and environmental considerations.
Product: A printed report and a current computer file on social, economic
and environmental considerations.

TASK 3.0:. PARKING STUDY WITHIN THE CBD
Proposed Work: Make an actual count of parking spaces available within
the CBD. Estimate present parking needs and project future parking demand
within the CBD.
Previous Work: A study of available parking and projected probable
parking needs within the CBD was done in 1964. The Lubbock. Traffic Engineering
Department re -studied the parking situation in 1971.
Method: This study will utilize actual counts of parking spaces now
available, consider traffic counts and projections, and estimate future parking
needs.
Produce: Printed report with maps and tables.

Hiring the performance of this contract, the contractor, for itself, its assignees
land successors in interest (hereinafter referred to ad the "contractor"), agrees,
